REGULAR MEETING MAY 27, 2005 ADOPT RESOLUTION NO. 37 -2005 — A RESOLUTION OF THE BOARD OF PUBLIC-: WORKS OF THE CITY OF SOUTH BENS INDIANA, FIXING RTES AND CHARGES TO BE COLLECTED FOR THE PARKING OF VEHICLES AT MUNICIPALLY OPERAT['11) PARKING GARAGES Mr. Inks stated that the rate increase for the parking garages was only for the monthly parkifil , and it is the first time a rate increase has been requested since 2003. The previous rate increase was done seventeen (I7) years ago. Upon a notion made by Mr. Inks, seconded. by Mr, Littrell and carried, the followin Resolution was adopted by the Board of Public Works: RESOLUTION NO. 37 -2005 A RESOLUTION OF THE BOARD OF PUBLIC WORKS OE THE CITY OF SOUTH BEND, INDIANA, FIXING RATES AND CHARGES TO BE COLLECTED FOR THE PARKING OF VEHICLES AT MUNICIPALLY ORPERATED PARKING GARAGES WHEREAS, Ind. Code 36 -9 -I I -7 authorizes the Board of Public Works to fix reasonable rates for municipally operated parking garages, subject to approval of the Common Council, and NOW, THERE—FORE, BE IT RESOLVED by the Board of Public Works of the City of South Bend that the following monthly parking rates be established for the Colfax Street hari <ing Garage, the Wayne Street parking Garage, and the Leighton plaza Parking Garage: SECTION 1. The following monthly parking rates shall be charged for vehicles parked as City operated garages: Old lute New Rate A. Monthly rate — Standard Larking per vehicle in area Located above gates. $40.00 $45M B. Monthly Rate — Premium Parking Per vehicle in areas marked as RESERVED. $50,00 $55.00 The option to issue or renew agreements for parking in City -owned and operated garages lies with the sole discretion of the Board of Public Works or its designee. 1Jnles,., otherwise designated, parking spaces shall be allocated on a first comae, first served basis. Should the demand for parking exceed supply, priority for parking spaces shall be givers to those who pay the monthly rate as long as payment is timely and current. SECTION 11. At this time the Board of Public Works has designated the corporation AMPCO to operate and manage all City parking garages. AMPCO, or anA✓ successor to AMPCO designated by the Board of Works, through its agents and employees, shall have full power and authority within the confines of City operated parking facilities to enforce the rules and restrictions concerning parking time limits and'. the reservation of spaces for persons who pay premium rates and for those who have, handicap permits, SECTION III. The monthly rates and rules for City operated parking garages in this Resolution supersede those rates and rules established in prior Common Co ncil Ordinance No. 9397 -03, but the hourly rates set forth in Common Council Ordinance 9397 -03 shall remain in full force and effect. SECTION IV. The effective date of this Resolution shall be August 1, 2005 subject to approval by the Common Council.
