REGULAR MEETING MAY 27, 2005 <br />ADOPT RESOLUTION NO. 37 -2005 — A RESOLUTION OF THE BOARD OF PUBLIC-: <br />WORKS OF THE CITY OF SOUTH BENS INDIANA, FIXING RTES AND CHARGES TO <br />BE COLLECTED FOR THE PARKING OF VEHICLES AT MUNICIPALLY OPERAT['11) <br />PARKING GARAGES <br />Mr. Inks stated that the rate increase for the parking garages was only for the monthly parkifil , <br />and it is the first time a rate increase has been requested since 2003. The previous rate increase <br />was done seventeen (I7) years ago. Upon a notion made by Mr. Inks, seconded. by Mr, Littrell <br />and carried, the followin Resolution was adopted by the Board of Public Works: <br />RESOLUTION NO. 37 -2005 <br />A RESOLUTION OF THE BOARD OF PUBLIC WORKS OE THE CITY OF SOUTH BEND, <br />INDIANA, FIXING RATES AND CHARGES TO BE COLLECTED FOR THE PARKING OF <br />VEHICLES AT MUNICIPALLY ORPERATED PARKING GARAGES <br />WHEREAS, Ind. Code 36 -9 -I I -7 authorizes the Board of Public Works to fix reasonable <br />rates for municipally operated parking garages, subject to approval of the Common Council, and <br />NOW, THERE—FORE, BE IT RESOLVED by the Board of Public Works of the City of <br />South Bend that the following monthly parking rates be established for the Colfax Street hari <ing <br />Garage, the Wayne Street parking Garage, and the Leighton plaza Parking Garage: <br />SECTION 1. The following monthly parking rates shall be charged for vehicles parked as <br />City operated garages: <br />Old lute New Rate <br />A. Monthly rate — Standard <br />Larking per vehicle in area <br />Located above gates. $40.00 $45M <br />B. Monthly Rate — Premium Parking <br />Per vehicle in areas marked as <br />RESERVED. <br />$50,00 $55.00 <br />The option to issue or renew agreements for parking in City -owned and operated <br />garages lies with the sole discretion of the Board of Public Works or its designee. 1Jnles,., <br />otherwise designated, parking spaces shall be allocated on a first comae, first served basis. <br />Should the demand for parking exceed supply, priority for parking spaces shall be givers <br />to those who pay the monthly rate as long as payment is timely and current. <br />SECTION 11. At this time the Board of Public Works has designated the <br />corporation AMPCO to operate and manage all City parking garages. AMPCO, or anA✓ <br />successor to AMPCO designated by the Board of Works, through its agents and <br />employees, shall have full power and authority within the confines of City operated <br />parking facilities to enforce the rules and restrictions concerning parking time limits and'. <br />the reservation of spaces for persons who pay premium rates and for those who have, <br />handicap permits, <br />SECTION III. The monthly rates and rules for City operated parking garages in <br />this Resolution supersede those rates and rules established in prior Common Co ncil <br />Ordinance No. 9397 -03, but the hourly rates set forth in Common Council Ordinance <br />9397 -03 shall remain in full force and effect. <br />SECTION IV. The effective date of this Resolution shall be August 1, 2005 <br />subject to approval by the Common Council. <br />
