Qtoututitt *oat: Zoning anZi finnuation tontinittet The March 12, 2001 meeting of the Zoning and Annexation Committee was called to order by its Chairperson,Council Member Karen White at 4:00 p.m. in the Council Informal Meeting Room. Persons in attendance included Council Members: Aranowski, Pfeifer, King, Kelly, Varner, Ujdak, Coleman, White and Kirsits; Community and Economic Development Director Jon Hunt, Historic Preservation Commission Acting Director John Oxian, Assistant Area Plan Director John Byomi, Attorney Bruce Bancroft, City Engineer Carl Littrell. Michael Dansch, Ted Foti of Memorial Hospital, Mayor's Administrative Assistant Fred Thon, Public Works Director Gary Gilot, Terry Bland of the i+outJj Venti tribunt, and Kathleen Cekanski-Farrand, Council Attorney. Council Member White noted that the first item on the agenda was to review Bill No. 10-01 which is a request to establish an historic landmark for the railroad bridge located across the St. Joseph River which is adjacent to the Angela Street Bridge. Historic Preservation Commission Acting Director John Oxian stated that the Historic Preservation Commission is recommending that the Norfolk & Southern Railroad Bridge be designated as a local landmark. It is believed to have been constructed in the mid 1890's which consists of a deck plate girder bridge with four(43) concrete supports, iron girder and plat deck. It meets three 3 local criteria for local designation. ( ) The Council Attorney noted that she has been in contact with the attorney representing the railroad who has raised a federal pre-emption issue with regard to the proposed action. She requested that the Bill be continued until the Council meeting of April 9th to allow herself and the Legal Department to continue discussions with the railroad's legal counsel. Mr. Oxian consented to the continuance request however noted that prior to legal counsel for the railroad becoming involved that the railroad had proposed to donate the railroad bridge to the City. Following discussion, Council Member Varner made a motion, seconded by Council Member Coleman that Bill No. 10-01 be continued until the April 9th Council meeting. The motion passed. The Committee then reviewed Bill No. 3-01 which is a request to rezone the property located at 814 and 816 North Main Street. Area Plan Assistant Director John Byomi noted that the staff and the Area Plan Commissio recommend Bill No. 3-01 favorably to Council. n Mr. Bruce Bancroft the attorney for the Petitioner, Memorial Hospital made the presentation. He noted that the rezoning would permit a parking lot to be constructed for employees of Memorial. Following discussion, Council Member Coleman made a motion, seconded by Council Member Varner that Bill No. 3-01 be recommended unfavorably to Council. The motion passed. Council Member Coleman noted that he was able to retrieve a brick from what once was his grandfather's home from this location. The Committee then reviewed Substitute Bill No. 4-01 which is a rezoning request for the property located at 109 South St. Louis and 616 Fast Washington Street.
