Coal Line Trail Phase 3 » City of South Bend Page 4 <br />PROJECT APPROACH <br />Environmental Documentation <br />The use of federal funding triggers compliance with National Environmental <br />Policy Act (NEPA) documentation requirements. DLZ has conducted a field <br />visit and preliminary reviews of GIS data available on the IndianaMap website, <br />the IDEM VFC, IDNR’s Indiana Buildings, Bridges, and Cemeteries Map website <br />and other information to identify potential “red flag” resources or issues <br />that may need to be considered during design. RFI resources/issues noted <br />in the project area include an abandoned railroad, a brownfields site, two <br />leaking underground storage tank (LUST) sites, two state cleanup sites and a <br />public park were noted within the project area. The identified items are not <br />anticipated to impede project development. <br />The project will also require compliance with Section 106 of the National <br />Historic Preservation Act, which sets forth a review process for identifying <br />historic properties (including archaeological sites) and assessing potential <br />effects. The project may be approved under the MPPA. Qualified professional <br />subconsultant services would be required if the project were to require new <br />permanent right of way or would impact historic character-defining features or <br />previously undisturbed soils. <br />A Level 1 Categorical Exclusion (CE) would be required if the project were to <br />acquire less than 0.5 acre of new right of way. A Level 2 CE would be required <br />if the project were to acquire more than 0.5 acre of new right of way. A Level 4 <br />CE would be required for involvement with Kennedy Park. <br />CHALLENGES SOLUTIONS <br />Section 106 The project proposes work types for which Section 106 approval may be issued under the Minor Projects Programmatic Agreement <br />(MPPA). MPPA applicability will expedite completion of the NEPA documentation. <br />Section 4(f)Kennedy Park is located at the south project terminus and the site of the National Register-listed South Bend Brewing Company <br />(now demolished) is located near the north project terminus. No Section 4(f) uses are anticipated. <br />Stream and Water <br />Quality Impacts <br />Implementation of INDOT Standard Specifications is anticipated to adequately address water quality concerns. Impacts requiring <br />mitigation are not anticipated. <br />Wetlands No wetlands were noted in or near the project area. Impacts are not anticipated. <br />Floodplains/ <br />Floodways No floodplains were noted in or near the project area. Impacts are not anticipated. <br />Threatened and <br />Endangered Species <br />DLZ will conduct programmatic consultation for bat species of concern using the on-line USFWS IPaC system, which streamlines <br />the consultation process. A “No Effect” determination, or “May Affect, Not Likely to Adversely Affect” determination is anticipated. <br />If trees are removed/trimmed, a seasonal tree clearing restriction is expected (trees may not be removed from April 1 through <br />September 30). <br />Hazardous <br />Materials Sites <br />Several hazardous materials sites were noted within the project area. Early in project development, DLZ will complete a Red Flag <br />Investigation (RFI) and will coordinate with the INDOT Site Assessment and Management Unit to determine the need for additional <br />investigations. The identified sites are not anticipated to impede project development given the minor nature of trail construction.
