(ommitt*s Z*port: <br /> Zoning and Annexation Committee <br /> go tij* COMM, touttutj of the CO of SOUL j <br /> The July 10, 1995 meeting of the Zoning and Annexation Committee was called to <br /> order by its Chairperson, Council Member Lee Slavinskas at 4:20 P.M. in the Council <br /> informal meeting room. <br /> Persons in attendance included Council Members: Luecke, Kelly, Washington, <br /> Puzzello, Slavinskas, Zakrzewski, Coleman, Duda, and Ladewski; John Byorni, David <br /> Duvall, John Oxian, Citizen Member Doug Carpenter, Dave Rumbah, Don Porter, and <br /> Kathleen Cekanski-Farrand. <br /> The first item on the agenda was to review Substitute Bill No. 26-95 which would <br /> amend Chapter 21 of the South Bend Municipal Code addressing gambling games and <br /> related activities. <br /> Mr. John Byorni noted that both the Staff and the Commission send this Substitute <br /> Bill to the Council favorably. • <br /> Council Member Steve Luecke the sponsor of the Bill then made the presentation. <br /> He noted that it is similar to the Bill which the Council passed in November of last year <br /> regarding wagering and off-track betting facilities. This Bill would enlarge that to address <br /> gambling to address gambling games as defined by state law. He believes that it sets forth <br /> reasonable regulations that promote and protect the public health safety and general welfare <br /> of the community through proper zoning regulations. <br /> Council Member Slavinskas questioned whether the reference could be zoning to a <br /> residential use as opposed to a residential district in light of the problems raised with the <br /> adult book store attempting to relocate within the City of South Bend. <br /> The Council Attorney noted that this would be a major change in the Bill and it <br /> would have to go back to the Area Plan Commission. In light of that, Council Member <br /> Slavinskas stated that he would like this addressed separately. <br /> Doug Carpenter, the Citizen Member of the Committee had questions with regard to <br /> signage which Council Member Luecke addressed. <br /> Following further discussion, Council Member Puzzello made a motion, seconded <br /> by Citizen Member Doug Carpenter that Substitute Bill No. 26-95 be recommended <br /> favorably to Council. The motion passed. <br /> The Committee then reviewed Bill No. 30-95 which would amend Chapter 21 of <br /> the South Bend Municipal Code addressing the powers and duties of the Historic <br /> Preservation Commission. Mr. David Duvall made the presentation.He noted that this is an <br /> amended Bill which would still require hearings before the Historic Preservation <br /> Commission and the Common Council. <br /> Following discussion, Council Member Luecke made a motion, seconded by <br /> Council Member Puzzello the Substitute Bill No. 30-95 be recommended favorably to <br /> Council. The motion passed. <br />
