Sec. 16-29. - Tipping charges; purchase of recycled yard waste products; exemptions. <br /> a) Tipping charges for disposal of yard waste at the Organic Resource Facility are set at three <br /> dollars and sixty-five cents($3.65)per cubic yard for customers living within the city limits <br /> of South Bend and eleven dollars ($11.00)per cubic yard for customers living outside the <br /> city limits of South Bend. <br /> b) Compost, wood chips and other recycled yard waste products may be obtained from <br /> the Organic Resource Facility at no charge if the person loads the material themself. <br /> hin el If employees at the City or its agents load such material(s) the cost for <br /> materials up to four (4) cubic yards shall be five dollars ($5.00) excluding sales tax, per <br /> cubic yard. For loading of more than four (4) cubic yards the loading fee shall be nine <br /> dollars ($9.00) excluding sales tax, per cubic yard for all yards, including the first four(4) <br /> cubic yards. • - - . . . .. Delivery to a specific site may also be provided for loads between a minimum of <br /> (twenty) 20 cubic yards and a maximum of twenty-five (25) cubic yards at a separate <br /> delivery charge of fifteen dollars ($15.00) four dollars ($1 00) per cubic yard, excluding <br /> sales tax. <br /> c) The Board of Public Works,pursuant to the powers granted by IC 36-9-30, may from time <br /> to time adjust and change the tipping charges at the Organic Resource Facility and the <br /> charges for the purchase of recycled yard waste products set out above. Such changes and <br /> adjustments may be made only after a public hearing and shall be based upon the actual <br /> cost of processing the yard waste, producing the recycled product, and operating <br /> the Organic Resource Facility, including the establishment of a reasonable reserve for <br /> capital improvements. <br /> d) The following programs and departments of the City shall be exempt from payment of the <br /> tipping charges set out above: <br /> Operation Relief • <br /> Solid Waste/Yard Waste Program <br /> Park Department <br /> e) All City departments and programs shall be exempt from the payment of charges for <br /> recycled yard waste products. <br /> (Ord.
