Sec. 16-29. - Tipping charges; purchase of recycled yard waste products; exemptions. a) Tipping charges for disposal of yard waste at the Organic Resource Facility are set at three dollars and sixty-five cents($3.65)per cubic yard for customers living within the city limits of South Bend and eleven dollars ($11.00)per cubic yard for customers living outside the city limits of South Bend. b) Compost, wood chips and other recycled yard waste products may be obtained from the Organic Resource Facility at no charge if the person loads the material themself. hin el If employees at the City or its agents load such material(s) the cost for materials up to four (4) cubic yards shall be five dollars ($5.00) excluding sales tax, per cubic yard. For loading of more than four (4) cubic yards the loading fee shall be nine dollars ($9.00) excluding sales tax, per cubic yard for all yards, including the first four(4) cubic yards. • - - . . . .. Delivery to a specific site may also be provided for loads between a minimum of (twenty) 20 cubic yards and a maximum of twenty-five (25) cubic yards at a separate delivery charge of fifteen dollars ($15.00) four dollars ($1 00) per cubic yard, excluding sales tax. c) The Board of Public Works,pursuant to the powers granted by IC 36-9-30, may from time to time adjust and change the tipping charges at the Organic Resource Facility and the charges for the purchase of recycled yard waste products set out above. Such changes and adjustments may be made only after a public hearing and shall be based upon the actual cost of processing the yard waste, producing the recycled product, and operating the Organic Resource Facility, including the establishment of a reasonable reserve for capital improvements. d) The following programs and departments of the City shall be exempt from payment of the tipping charges set out above: Operation Relief • Solid Waste/Yard Waste Program Park Department e) All City departments and programs shall be exempt from the payment of charges for recycled yard waste products. This Ordinance shall be in full force and effect from and after its passage by the Common Council, approval by the Mayor, and any publication required by law, but no earlier than January 1, 2023.
