BILL NO. 47-22 <br /> ORDINANCE NO. 10881-22 <br /> AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH BEND, <br /> INDIANA, AMENDING TIPPING AND LOADING CHARGES FOR YARD WASTE <br /> CUSTOMER WITHIN TWO SECTIONS OF CHAPTER 16, ARTICLE 4 OF THE <br /> SOUTH BEND MUNICIPAL CODE <br /> STATEMENT OF PURPOSE AND INTENT <br /> The City's Organic Resources facility collects and processes yard waste materials from <br /> area residents. This service is separate from the City's yard waste program where residents can <br /> sign up to receive their own yard waste bin which is picked up weekly. Material taken to the <br /> Organic Resources facility is processed and converted into mulch and compost for area residents <br /> to use at no cost if they are self-loading. The City currently charges the same tipping fee for <br /> customers both inside and outside the corporate limits of South Bend to bring in yard waste <br /> material. A loading fee is also charged if City staff use their equipment to load mulch and compost <br /> into customers vehicles. <br /> This ordinance increases the tipping fees for customers who live outside the corporate <br /> limits of South Bend to dispose of yard waste material. Loading charges for mulch and compost <br /> are also adjusted for all customers. These changes are meant to better reflect the actual operational <br /> costs of services provided to customers. <br /> This ordinance is necessary for the effective, efficient operation of the City's Organic <br /> Resources facility and is in the best interest of the City and its citizens. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY <br /> OF SOUTH BEND, INDIANA as follows: <br /> SECTION I: The South Bend Municipal Code at Section 16-27 and Section 16-29 of <br /> Article 4 is hereby amended to read in its entirety as follows: <br /> Sec. 16-27.—Policy regarding disposal of yard waste. <br /> It is hereby stated as the policy and law of the City of South Bend that all yard waste as <br /> defined herein generated by or emanating from the City, whether from residential, commercial, <br /> industrial, institutional or governmental sources, shall not be landfilled. Such yard waste, whether <br /> collected by the City, commercial lawn services, tree services or private carriers, shall be disposed <br /> of at the City's Organic Resource Facility for recycling; provided, however, that nothing herein <br /> shall prevent any individual or company from otherwise recycling yard waste in a manner <br /> approved by the Director of the Department of Public Works. : . . . - - . --•. • <br /> .. . <br /> (Ord.
