COMM tttt Ztport: <br /> Public Works and Property Vacation Committee <br /> to the Common Council of the City of South Natty: <br /> The December 18, 1995 meeting of the Public Works and Property Vacation <br /> Committee was called to order by its Chairperson, Council Member Ann Puzzello at 4:05 <br /> P.M.in the Council informal meeting room. <br /> Persons in attendance included Council Members: Puzzello, Luecke, Kelly, <br /> Zakrzewski, Duda, Washington, Slavinskas, Coleman, and Ladewski; Ed Hardig, Bruce <br /> Bankcroft,Mary Jane Choice,Don Porter, and Kathleen Cekanski-Farrand. <br /> The first item on the agenda was to review substitute Bill No. 66-95 which is a <br /> request to vacate certain property in the City of South Bend. <br /> Council Member Puzzello noted that this Bill was continued from the last meeting. <br /> Mr. Bruce Bankcroft the attorney representing Memorial Hospital then made the <br /> presentation.He noted that it was his understanding that Mr.Freedline voiced concern with <br /> regard to the proposed vacation at the last Common Council meeting.He noted that he had <br /> met with Mr. Freedline and that the hospital had worked out an agreement with Mr. <br /> Freedline so that a easement for Mar Main Apartments would be forth coming. He noted <br /> that the easement would allow vehicles going east in the alley so that they could make a left <br /> turn onto Navarre street the easement would be recorded. He noted that it would be a 30 <br /> foot north and south and 24 feet east and west from the east side of the alley. The Council <br /> Attorney suggested that Section I of the substitute Bill be amended by including the <br /> following language,that the period be struck with the following addition, <br /> ", subject to an easement agreement which shall be recorded by the <br /> petitioner with a copy being filed with the City Clerk." Mr. Bankcroft agreed to the <br /> proposed amendment from the Council Attorney. <br /> Mary Jane Choice of the Mar Main Apartments noted that their primary concern is <br /> the safety of their tenants. She noted that access is necessary for ambulances. She stated <br /> that she is pleased that the owner of the Mar Main Apartments was able to work out an <br /> agreement with Memorial Hospital but voiced concern if there is a fire and wanted to make <br /> sure that fire trucks and ambulances would have access to the facility. <br /> Following discussion, Council Member Kelly made a motion, seconded by Council <br /> Member Duda that substitute Bill No. 66-95 as amended by the Committee be <br /> recommended favorably to Council. The motion passed. <br /> It was also noted by Council Member Duda that Bill No. 66-95 received a favorable <br /> recommendation from the Board of Public Works(copy attached). <br /> The Committee then reviewed Bill No. 79-95 which is a request to vacate certain <br /> property in the City of South Bend. Mr. Ed Hardig the attorney for Milton Inc. doing <br /> business as the Milton Home made the presentation.He then passed out to the Committee a <br /> copy of the Common Council meeting records of 1867,which noted that the home would <br /> always be there for the Council.He also passed out a map from that period of time. <br />
