emadt <br /> eo lit Inittu *.tport: <br /> Community and Economic Development <br /> tbt Common toutttiU of t e Qtitt of South IStnb: <br /> The September 26, 1994 meeting of the Community and Economic Development <br /> Committee was called to order by its Chairperson, Council Member Roland Kelly at 4:55 <br /> p.m. in the Council informal meeting room. <br /> Persons in attendance included Council Members Luecke, Kelly, Puzzello, <br /> Washington, Duda, Slavinskas, Coleman, Zakrzewski, and Ladewski; Mike Beitzinger, <br /> William Eagen,John Broden,David Merkin,Dennise Sullivan, Carry Levin, Carl Littrell, <br /> Don Porter, and Kathleen Cekanski-Farrand <br /> First item on the agenda was to review Resolution No. 94-88 which is a Tax <br /> Abatement request for the property located at 1145-1305 Prairie Ave.Mr. Mike Beitzinger <br /> reviewed the report dated July 5, 1994 (copy attached). It noted that the project calls for <br /> the purchase and installation of two Hydraulic Pedestal Cranes and a wire line. Total <br /> project costs are estimated at$1,280,000.00, and would create 16 new permanent jobs. <br /> The Council Attorney then provided a hand-out to each of the Committee Members <br /> which contained a copy of the state law authorizing the Council to establish general <br /> standards and reasonable conditions with regard to new manufacturing equipment. Also <br /> attached was ro osed language for a new section 9 with current section 10 of the <br /> P P <br /> Resolution to be amended prepared by the City Legal Department. <br /> Mr John Broden of the City Attorney's office then reviewed the background <br /> information and the need for such an amendment to the Resolution. <br /> Mr. David Merkin, the Attorney for the petitioner noted that the law suit regarding <br /> noise levels by the City was dismissed. He stated that the decibels levels requested are an <br /> impossible standard. Mr. Carry Levin then spoke before the Committee. He stated that <br /> despite the request from the Common Council at the last Committee hearing and Council <br /> meeting, that he did not have any information available with regard to noise levels of the <br /> new equipment in question. He stated however that he is seeking information from a <br /> company in France. <br /> Council Member Slavinskas questioned whether the cranes would be replacing <br /> current ones and was advised that they were. It was noted that they are currently using <br /> diesel cranes which would be replaced by Hydraulic Cranes. Mr. Levin also noted in <br /> response to Council Member Slavinskas that they could further insulate the pedestals of the <br /> cranes. <br /> Council Member Zakrzewski stated that he is concerned in light of the fact that the <br /> requested noise levels of the new manufacturing equipment had not be provided. He stated <br /> that there is absolutely no proof before this Council with regard to what the noise levels <br /> would be. He noted that residents can hear noise as far away as three blocks and they <br /> continue to be awakened between the hours of 2:00 to 4:00 A.M. He further stated that he <br /> wants something built into the Resolution other than the judicial system. <br /> Council Member Washington voiced a potential equal protection argument. <br />
