3 <br />•~ <br />i• <br /> <br />• T <br />WHEREAS, the Common Council at a meeting on May 23, 1988 and <br />after a public hearing, adopted Ordinance No. 7875-88 approving the <br />Lease; and <br />WHEREAS, the State Board of Tax Commissioners issued its Order <br />approving the Lease pursuant to IC 6-1.1-18.5-8 on June 14, 1988; and <br />WHEREAS,. the Autharity desires to approve modifications to the <br />Lease which do not increase the term of the Lease or the rental <br />amount of the Lease, and further desires to execute the Lease, as <br />modified, a copy of which is attached hereto as "Exhibit A;" and <br />WHEREAS, the Authority desires to approve a contract for the sale <br />and purchase. of land (the "Purchase Agreement") upon which the <br />Parking Facility will be built, to permit the sale of said land to <br />the Authority by the Commission, a copy of which Purchase Agreement. <br />is attached as "Exhibit B;" and <br />NOW,. THEREFORE, BE IT RESOLVED. BY THE SOUTH BEND REDEVELOPMENT <br />AUTHORITY A5 FOLLOWS: <br />1. The Authority hereby approves the modifications to the Lease <br />and: approves. said Lease, as modified. <br />2. The President and Secretary of the Authority are hereby <br />authorized and directed to execute and attest, respectively, the <br />Lease, as modified, in the form attached hereto as "Exhibit A." <br />3. The Secretary of the Authority is hereby directed to file a <br />copy of the Lease, as modified and executed, with the Commission. <br />-2- <br />
