Terms: Payment due on invoice, billed monthly based upon progress/hours expended and expenses incurred 7. Purpose and use of estimate: The intent of any estimate or study prepared pursuant to this agreement is to reflect fair market value for the construction of this project. It is not a prediction of lowest, or any, bid. It is an opinion of probable cost intended as a tool for cost control during the design process. MossCost can not and does not guarantee that bids, proposals or actual construction costs will not vary from any such estimate or study. 7. Sufficiency of design and funding: Moss Construction Cost Management Inc has no control over the quality, completeness, intricacy, constructability, or coordination of design documents, or over the amount of funds available for this project. Therefore, Moss Construction Cost Management Inc is not responsible for design revision costs in the event that the estimate is in excess of the established budget. 8. Remedies: The sole and exclusive remedy for estimator errors and/or omissions shall be (a) for estimator to correct errors and/or omissions without additional compensation from Client or (b) for Client to have errors and/or omissions corrected by other suitably qualified personnel at estimator’s expense. 9. Insurance: Fee is based upon MossCost standard insurances. Should Client request any change in policy limits, terms or requires adding as a named insured, and provided such can be procured, Client will reimburse MossCost for the cost of said additional insurance, plus a 15% administrative fee. 10. Use of Images & project data: MossCost reserves the right to use descriptions and images of the project for marketing purposes only. Such uses will include the copyright notice/source as appropriate. 11. Validity: Unless otherwise agreed in writing, this proposal is open to acceptance for sixty days from the date of issue. Rates, fees and prices herein are valid for work executed up to and including December 31, 2022. Work performed after this date will be subject to inflationary adjustment at a rate of 3% escalation per annum for subsequent years. 12.
