t
Zoning and Vacation Committee
November 23, 1992
Page 2
The Committee then reviewed Bill No. 92-92 which is a request to vacate a fourteen foot
alley between Clover Road and Oakland Street. Mr. Tom McGovern of Taylor and Moyer
Insurance Company gave the presentation. He stated that his company would pave the
alley and then it would be utilized by their employees and customers.
Council Member Kelly noted that the alley is in his district and he would be in favor of the
request. It was noted that the Board of Public Works had not sent a recommendation on
this bill. Joann Harper of the City-Clerk's office noted that there had been different legal
descriptions provided in the original bill. Accordingly, the Board of Public Works had
note taken action in light of the new legal description.
Following further discussion, Council Member Puzzello made a motion, seconded by
Council Member Coleman, that the Bill be sent to Council without recommendation. The
motion passed.
Mr. John Byroni then introduced Mr. Steve Rudisell, a new subdivision planner with the
Area Plan Commission.
Council Member Slavinskas voiced concern with regard to the use of property zoned "C"
"Commercial" and whether uses could be pyramided. He noted that there is an ongoing
dispute between the Building Department and the Area Plan Staff.
The Council Attorney also noted that she had sent a memorandum to the Committee
addressing s ecial exceptions and a proposed form of resolution. She requested that the
Committee review this so that action could be taken upon it at its next Committee meeting.
Council Member Slavinskas also noted that the Area Plan Staff and the Committee should
meet beginning next year on the proposed " 0-Zoning" ordinance. He recalled that the only
concern raised to date was with regard to parking voiced by the former head of the Code
Enforcement Office.
It was also noted that Bill No. 84-92 which is a historic landmark request for the property
located at 514 East Indiana Avenue would be continued until January.
There being no further business to come before the Committee the meeting was adjourned
at 4:10 p.m.
Respectfully submitted,
Council Member Lee Slavinskas
Chairperson Zoning and Vacation Committee
attachments
