Zoning and Vacation Committee <br /> May 11, 1992 <br /> Page 2 <br /> Council President Luecke noted that current zoning laws do not allow this unless a special <br /> exception is approved by the Council. It was also noted that a final site plan would be <br /> forthcoming which would have the requirements of the Building Commissioner and the <br /> State Fire Marshal. <br /> Following further discussion Council Member Coleman made a motion seconded by <br /> Council Member Washington that Resolution No. 92-37 be recommended favorably to <br /> Council. The motion passed. <br /> The Committee then reviewed Resolution No. 92-38 which would approve a petition from <br /> the South Bend Board of Zoning Appeals on a special exception for recreational use on <br /> Commercial property located at the Southwest corner of Lombardy and Meadow Lane. <br /> Council Member Zakrzewski stated that this petition has been filed by Maurice Matthys <br /> Little League so that the parking area could be upgraded. <br /> Mr. Robert Nagle noted that the Board of Zoning Appeals gave a favorable <br /> recommendation pursuant to Section 21-112 of the South Bend Municipal Code. <br /> Following further discussion Council Member Coleman made a motion seconded by <br /> Council Member Washington that Resolution No. 92-38 be recommended favorably to <br /> Council. The motion passed. <br /> The Committee then reviewed Resolution No.92-39 which would approve a petition of the <br /> South Bend Board of Zoning Appeals on a special exception for combined use of <br /> commercial property located at 1117 Western Avenue. Mr. Sam Mercantini gave the <br /> presentation. He noted that there would be six apartments upstairs two of which would be <br /> two bedrooms with the remaining being one bedroom and two commercial sites on the first <br /> floor. The commercial uses would include a day care and a sports clothing consignment. <br /> Eleven parking spaces would be provided. <br /> Mr. Robert Nagle noted that the BCA gave a favorable recommendation at its meeting of <br /> April 16, 1992. Council Member Ladewski questioned whether proper notice was given <br /> and was advised that it was. <br /> Following further discussion, Council Member Coleman made a motion seconded by <br /> Council member Washington that Resolution No. 92-39 be recommended favorably to <br /> Council.
