committer E■tport <br /> ZONING AND VACATION COMMITTEE <br /> Zo the atom= Council of tip (Mg of E►outil 3�rnd: <br /> The September 9, 1991 meeting of the Zoning and Vacation <br /> Committee was called to order by its chairperson, Council <br /> Member Lee Slavinskas at 4:07 p.m. in the Council informal <br /> meeting room. <br /> Persons in attendance included Council Members: Slavinskas, <br /> Coleman, Luecke, Duda, Zakrewski, Ladewski, Soderberg, <br /> Puzzelo, and Niezgodkski; John Byorni, Frank Mulligan, Don <br /> Porter, and Kathleen Cekanski-Farrand. <br /> Council Member Slavinskas noted that the purpose of the Bill <br /> was to review Substitute Bill No. 43-91, which is a Zoning <br /> Ordinance specifically addressing "Sign Regulations. " <br /> Council Member Slavinskas noted that a series of 4 feet by 8 <br /> feet billboards have appeared in recent political elections <br /> in the fron yeards in residential areas. He has received <br /> many comments from individuals seeking to prohibit such <br /> signage. The Area Plan Commission recommended favorably the <br /> Substitute Bill to the Common Council. <br /> Council Member Zakrzewski voiced concern with regard to <br /> whether thirty days was long enough prior to an election for <br /> the posting of such political signs. He noted that he would <br /> prefer a forty-five day limit. Council Member Duda also <br /> voiced concern with regard to the time limitations. <br /> Council Member Coleman stated that he believes the Bill is <br /> basically a good idea and a good Bill. He noted, however, <br /> that there should be some considerations to the following <br /> items, such as many members of the public do not even <br /> realize that an election is going on until they see the <br /> political signs. He also voiced concern with regard to the <br /> candidate who has a very small crew who may not be able to <br /> post such signs within a thirty-day period and perhaps a <br /> longer period of time would be more appropriate. <br /> Council Member Luecke stated that there may be some <br /> constitutional issues with regard to free speech if the time <br /> limitation is not reasonable. He, therefore, made a motion, <br /> seconded by Council Member Coleman to strike Subparagraph 2 <br /> from Section I (k) and to renumber Subparagraph 3 to become <br /> Subparagraph 2. The motion passed. <br /> Council Member Luecke also noted that the penalty in the <br /> Bill is for the entire Article 10, thus all types of sign <br /> regulations would be subject to the Ordinance violation of a <br /> twenty-five ($25.00) dollar fine for the first offense and a <br /> fifty ($50.00) dollar fine for subsequent offenses. <br />
