March 22, 2022 <br />LWW LLC <br />PO Box 462 <br />Mishawaka, IN 46546 <br />Re: Violations of City Ordinance at 1636 LINCOLNWAY, South Bend, IN 46628/First Notice <br />To Whom It May Concern: <br />This letter is to advise you that you are in violation of the City of South Bend Zoning Ordinance, <br />at your property located at 1636 LINCOLNWAY, South Bend, IN 46628. This property is zoned <br />“NC” Neighborhood Center. <br />The above-referenced property has the following violations: <br />1.Section 21-10(f)(2) The failure to obtain an improvement location permit when one is <br />required by the terms and provisions of this Ordinance, Section 21-10(f)(2), specifically <br />doing construction remodeling without application for applicable commercial building <br />permits. <br />VIOLATION REMEDY <br />Make applicable commercial application permit and Construction Design Release from <br />the State of Indiana. <br />2.Section 6-6.2(b) Use and Occupancy. No building or structure as listed in Subsection <br />6.6.2(a) shall be used or occupied until the building official has issued a Certificate of <br />Occupancy as provided herein. Issuance of a Certificate of Occupancy shall not be <br />construed as an approval or waiver of a violation of the provisions of the Building Codes <br />or of any other ordinances enforced by the Building Department. It shall be unlawful to <br />use or occupy a building or structure as listed in Subsection 6.6.2(a) without the issuance <br />of a Certificate of Occupancy. <br />VIOLATION REMEDY <br />Obtain Certificate of Occupancy to use and occupy the building. <br />3.Section 6-6.1(a) It shall be unlawful for any person, firm or corporation to erect, <br />construct, enlarge, alter, repair, move, improve, remove, convert, demolish, equip, use, <br />occupy, or maintain any building or structure in the City or permit the same to be done, in <br />violation of any of the provisions of the Building Code.
