Version 6-8-2017 <br />27 <br />Q.Right of Way Acquisition Services <br />In fulfillment of this Contract, the CONSULTANT shall comply with the requirements of the <br />appropriate regulations and requirements of the Indiana Department of Transportation and Federal <br />Highway Administration. <br />It is anticipated the project requires acquisition from approximately 11 parcels. <br />The CONSULTANT shall perform all Right of Way Acquisition activities in accordance with INDOT’s <br />and FHWA’s procedures as outlined in the Real Estate Division Manual by INDOT, August 2021. Right <br />of Way Acquisition activities are as follows: <br />1.The CONSULTANT shall provide Right of Way Early Assessment for each parcel to be acquired. <br />Such activities may include development of probable right of way costs, determination of appraisal <br />types, right of way evaluation for identification of land improvements, cost-to-cure items, severance <br />damages and evaluation for mitigation of project right of way impacts. <br />2.The CONSULTANT may engage, as a subcontractor, a review appraiser who shall prepare an <br />Appraisal Problem Analysis (APA). <br />3.When the appraiser advises that he requires the right of way taking to be staked so that the appraisal <br />process can proceed, the CONSULTANT will mark the point where the new right of way line <br />crosses each property line and will mark each property corner within the proposed taking. When <br />directed, the CONSULTANT will stake the approximate location of the existing right of way lines <br />to assist the property owner to visualize the amount of proposed property to be acquired. Points <br />will be marked by survey stake. The right of way staking is based on completing all parcels once <br />(one time). <br />4.Upon review of the appraisal problem analysis and upon receipt of written authorization from the <br />LPA, the CONSULTANT shall cause each acquisition parcel to be appraised. The CONSULTANT <br />may utilize a member of the CONSULTANT’s staff for this purpose or may engage an INDOT- <br />approved appraiser as a subconsultant. <br />5.All such appraisals shall be reviewed by an INDOT approved review appraiser and then forwarded <br />to the LPA for approval of just compensation. The CONSULTANT may engage, as a <br />subcontractor, a review appraiser for each parcel. <br />6.Prepare transfer documents for each parcel including permanent and temporary parcels to be <br />acquired. <br />7.Upon approval of the appraisals and when specifically authorized by the LPA, the CONSULTANT <br />shall contact each parcel owner and make an offer to purchase the required property. The <br />CONSULTANT may utilize a member of the CONSULTANT’s staff for this purpose or may <br />engage an INDOT-approved buyer as a subconsultant. <br />8.Any modifications to the appraisal price or changes in the plans recommended during negotiations <br />must be approved by the LPA. <br />9.Appraising and buying coordination shall include the administration of subconsultant agreements <br />and coordination of title work, appraisal problem analysis, appraisals, review appraisals, just <br />compensation certification, buying and required approvals from the LPA, INDOT and FHWA. <br />Coordination does not include assistance with condemnation proceedings, property management, <br />or relocation, if required. <br />10.If required, the SUBCONSULTANT shall prepare Temporary Right of Entries for lead service line <br />replacement during the construction phase, if required. <br />R.The CONSULTANT shall perform all phases of the work described in this Agreement necessary to <br />accomplish the complete design of the project in conformity with the policies and standards set forth in <br />23 CFR 625, and in conformity with the standards adopted by the American Association of State and <br />Highway and Transportation Officials and approved by the Secretary of Transportation.
