Area Board of Zoning Appeals—December 5, 2012 <br /> DAVID MARTIN/BICYCLE GALLERY <br /> The petition of David Martin/Bicycle Gallery seeking a Special Exception to allow a tattoo, body piercing <br /> establishment in a"CBD"District and from the maximum allowable two controlled uses within i000`to 41, <br /> on property located at 127 W. Washington Street,Portage Township. Zoned"CBD". This was tabled from <br /> the November ABZA meeting. <br /> MR. DAVID MARTIN: I live at 56415 Westlea Drive, South Bend, Indiana. I'm the owner of Bicycle <br /> Gallery and I currently work at Marvel Tattoo on 933 North. What we are wanting to do is expand the scope <br /> of our business to include tattooing. Our goals are to expand and built on the art scene in South Bend. We <br /> want to be a cutting edge for art in South Bend and downtown. In South Bend many of the art galleries have <br /> limited hours mainly due to slow sales of art. By merging tattooing in the gallery will provide higher level of <br /> quality. By expanding art and tattooing we will be able to bring in higher traffic from the tattooing for <br /> exposure for the art and the will also lend class to the tattooing. I myself have been tattooing since 1996. I <br /> have always been tattooing in this area or close to it. I have been licensed in the county ever since there has <br /> been a licensing process. I'm always in good standing. I've never been a nuisance. The county's never had <br /> a problem with me. I am one of the foremost tattoo artist in Indiana. I draw clientele nationally. I really hope <br /> you guys go for this. <br /> MR. FEDDER: Just for the record. This is at 127 W. Washington Street here in South Bend? <br /> MR. MARTIN: Yes. It is currently operating as a gallery only, no tattooing yet. <br /> MR. PHIPPS: This is lust one. We had a photo and I think it said Urban Lily over the front door. Is it all <br /> the way to the corner? <br /> MR. MARTIN: No,no, it's just that one little section right there. The signage will be very limited too. We <br /> will keep the signage, like the tattooing, when we add,we get licensed, it will be very small. We won't have <br /> any big neon signs or anything like that because we want this to be very class. We want it to be upscale. <br /> MR. HAWLEY: Mr. Martin how do you determine, I noticed that it says, no one under the age of 18. If <br /> somebody walked in and they looked like they're 20 but they might only be 16, how do you determine their <br /> age? <br /> MR. MARTIN: Currently at Marvell Tattoo which I am currently employed at,we follow the county laws. <br /> What we do is we photo copy ID's and we keep them on hand. In the county we will not be, or in the city <br /> we will not tattoo anyone under 18,period. Piercing we will follow whatever the rules are for the city. <br /> MR. HAWLEY: But how do you prove that? How do you prove that they're... <br /> MR. MARTIN: They bring in their ID's, I mean if you can't accept an ID, I mean... <br /> 21 <br />
