<,~ • Resolution No. 135 A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT AUTHORITY ACCEPTING THE TRANSFER OF REAL PROPERTY FROM THE SOUTH BEND REDEVELOPMENT COMMISSION WHEREAS, the City of South Bend, Department of Redevelopment, ("Redevelopment") is the owner of the following described real property situated in St. Joseph County, Indiana: Parcel I. Lots Numbered Fifty-five (55), Fifty-six (56) and Fifty-seven (57) as shown on the recorded Plat of Samuel Martin's Addition to the Town, now City of South Bend, recorded in the Office of the Recorder of St. Joseph County, in Plat Book 3, page 28, together with the West Half (i/i) of the vacated alley lying East and adjacent to Lots Fifty-five (55), Fifty-six (56} and Fifty-seven (57) and together with the North Half (~h) of the vacated alley lying South and adjacent to said Lot Fifty-seven (57), and Parcel II. The South Half ('/i) of Lot Numbered Forty-four and all of Lot Forty-five (45) as shown on the recorded Plat of Samuel Martin's Addition to the Town, now City of South Bend, recorded in the Office of the Recorder of St. Joseph County, Indiana, in Plat Book 3, page 28, together with the East Half (i/i) of the vacated alley lying West of and adjacent to said parcel and together with the North Half (i/i) of the vacated alley lying South of and adjacent to said Lot Forty-five (45), (collectively hereinafter referred to as the Real Property); and • WHEREAS, pursuant to I.C. 36-7-14-12.2, the South Bend Redevelopment Commission (the "Commission") may dispose of real property; and WHEREAS, the Commission, desires to transfer the Real Property to the South Bend Redevelopment Authority (the "Authority") to finance its purchase through a Section 108 Loan; and WHEREAS, the Authority, desires to acquire the Real Property from the Commission; and WHEREAS, pursuant to LC. 36-1-11-8, the Commission may exchange or transfer property with another governmental entity upon terms and conditions agreed upon by the two (2) entities as evidenced by the adoption of substantially identical resolutions of each entity; and WHEREAS, the South Bend Redevelopment Commission, at its meeting of .Tu1v 16 , 1999, adopted its Resolution No. 1705 ,approving the transfer of the Real Property to the South Bend Redevelopment Authority. NOW, THEREFORE, BE TT RESOLVED BY THE SOUTH BEND REDEVELOPMENT AUTHORITY AS FOLLOWS: • 1. That the transfer of the Real Property situated in St. Joseph County, Indiana, and
