<,~ <br />• <br />Resolution No. 135 <br />A RESOLUTION OF THE SOUTH BEND REDEVELOPMENT AUTHORITY <br />ACCEPTING THE TRANSFER OF REAL PROPERTY <br />FROM THE SOUTH BEND REDEVELOPMENT COMMISSION <br />WHEREAS, the City of South Bend, Department of Redevelopment, ("Redevelopment") <br />is the owner of the following described real property situated in St. Joseph County, Indiana: <br />Parcel I. Lots Numbered Fifty-five (55), Fifty-six (56) and Fifty-seven (57) as shown on the <br />recorded Plat of Samuel Martin's Addition to the Town, now City of South Bend, recorded in the Office <br />of the Recorder of St. Joseph County, in Plat Book 3, page 28, together with the West Half (i/i) of the <br />vacated alley lying East and adjacent to Lots Fifty-five (55), Fifty-six (56} and Fifty-seven (57) and <br />together with the North Half (~h) of the vacated alley lying South and adjacent to said Lot Fifty-seven <br />(57), and <br />Parcel II. The South Half ('/i) of Lot Numbered Forty-four and all of Lot Forty-five (45) as <br />shown on the recorded Plat of Samuel Martin's Addition to the Town, now City of South Bend, recorded <br />in the Office of the Recorder of St. Joseph County, Indiana, in Plat Book 3, page 28, together with the <br />East Half (i/i) of the vacated alley lying West of and adjacent to said parcel and together with the North <br />Half (i/i) of the vacated alley lying South of and adjacent to said Lot Forty-five (45), <br />(collectively hereinafter referred to as the Real Property); and <br />• WHEREAS, pursuant to I.C. 36-7-14-12.2, the South Bend Redevelopment Commission <br />(the "Commission") may dispose of real property; and <br />WHEREAS, the Commission, desires to transfer the Real Property to the South Bend <br />Redevelopment Authority (the "Authority") to finance its purchase through a Section 108 Loan; <br />and <br />WHEREAS, the Authority, desires to acquire the Real Property from the Commission; <br />and <br />WHEREAS, pursuant to LC. 36-1-11-8, the Commission may exchange or transfer <br />property with another governmental entity upon terms and conditions agreed upon by the two <br />(2) entities as evidenced by the adoption of substantially identical resolutions of each entity; and <br />WHEREAS, the South Bend Redevelopment Commission, at its meeting of <br />.Tu1v 16 , 1999, adopted its Resolution No. 1705 ,approving the transfer of the <br />Real Property to the South Bend Redevelopment Authority. <br />NOW, THEREFORE, BE TT RESOLVED BY THE SOUTH BEND <br />REDEVELOPMENT AUTHORITY AS FOLLOWS: <br />• 1.
