Council Attorney to update the Committee. Kathleen <br /> Cekanski-Farrand then handed out a substitute version of <br /> Bill No. 8-88 (copy attached) . She noted that as a result <br /> of the last committee meeting that she had revised the Bill <br /> to incorporate the proposed changes. The first change was <br /> to require two sets of certified mailings; one for the Board <br /> of Public Works and one for the City Council to be presented <br /> by the petitioner for all property owners located within 50 <br /> feet of the exterior boundaries of the property proposed to <br /> be vacated. She also noted that she incorporated a two- <br /> tiered procedure addressing Councilman Luecke's suggestion <br /> where those proposed vacations that would be larger than <br /> thirty two hundred square feet. Such proposed vacates would <br /> be required to file a written appraisal prepared at the <br /> petitioner's cost and a certified check made payable to the <br /> City for the appraised value. She noted that she had <br /> discussed this with Councilman Voorde and with the <br /> Engineering Department. The average City block is between <br /> 400 to 450 feet. The average alley in width is anywhere <br /> from 12 to 14 feet. Therefore the 3200 square feet would be <br /> addressing larger public vacations. She also noted that the <br /> $150.00 would be non-refundable and any costs over and above <br /> that, which are directly related to advertising and <br /> recording, would be also paid by the petitioner. <br /> Councilman Zakrzewski had questions with regard to the 50 <br /> foot requirement. The Council Attorney noted that currently <br /> the State law requires that only abutting property owners <br /> receive notification and that the original bill had a <br /> requirement of 300 feet. The 50 feet designation was <br /> proposed as a reasonable compromise. JoAnn Harper of the <br /> City Clerk's Office voiced favorable support of the <br /> substitute version of the Bill. <br /> Following further discussion Councilman Soderberg made a <br /> motion seconded by Councilman Coleman that the substitute <br /> version of Bill No. 8-88 be recommended favorably to <br /> Council.
