44mmuinttittpanl <br /> PUBLIC WORKS COMMITTEE <br /> lb tilt Common Q ounrtl of tip etttg of Email limb: <br /> The October 10, 1988 meeting of the Public Works Committee . <br /> was called to order by its Chairman, Councilman Tom <br /> Zakrzewski at 5:00 p.m. in the Council informal meeting <br /> room. <br /> Persons in attendance included Councilmen Luecke, <br /> Niezgodski, Soderberg, Puzzello, Slavinskas, Zakrzewski, <br /> Coleman, and Duda; Attorney Ken Fedder, Mr. Abe Markus, <br /> Captain Ed Friend, Attorney Richard Nussbaum, James Wensits, <br /> Dick Maginot, and Kathleen Cekanski-Farrand. <br /> Councilman Zakrzewski noted that the purpose of the meeting <br /> was to continue to discussion with regard to Bill No. 74-88 <br /> which addressed truck routes. Councilman Zakrzewski then <br /> highlighted the changes in the proposed revision. He noted <br /> that pick-up trucks typically weigh approximately 8, 600 <br /> pounds and step vans are 10,000 pounds or more. <br /> Councilman Luecke questioned whether the trash trucks are <br /> exempted from the ordinance. Councilman Zakrzewski noted <br /> that a separate section which is not being amended in the <br /> Bill exempts such trash trucks. <br /> A revised copy of the Bill dated 10-40-88 was given to each <br /> of the Council members present. <br /> City Attorney Richard Nussbaum complimented Councilman <br /> Zakrzewski with regard to his effort on the Bill. He noted <br /> that several of the recommendations made by Corporal <br /> Stoynoff had been included. He believed that the overall <br /> Bill was enforceable. <br /> Mr. Ken Fedder questioned the wording on page 4, section 20- <br /> 8 (c) (1) and noted that the language does not address the <br /> situation where a pick-up document would be given to the <br /> driver upon pick-up. <br /> The Council Attorney, then read proposed amendatory language <br /> (copy attached) which Mr. Fedder believed would address the <br /> situation properly. <br /> Councilman Coleman also questioned whether amendments would <br /> be in order to the definition of truck on page one. <br /> Considerable discussion took place with amendatory language <br /> being discussed and approved by the Committee. (copy <br /> attached) Councilman Niezgodski stated that officers should <br /> have discretion and should use common sense with regard to <br /> enforcement of the ordinance. <br />
