44mmuinttittpanl PUBLIC WORKS COMMITTEE lb tilt Common Q ounrtl of tip etttg of Email limb: The October 10, 1988 meeting of the Public Works Committee . was called to order by its Chairman, Councilman Tom Zakrzewski at 5:00 p.m. in the Council informal meeting room. Persons in attendance included Councilmen Luecke, Niezgodski, Soderberg, Puzzello, Slavinskas, Zakrzewski, Coleman, and Duda; Attorney Ken Fedder, Mr. Abe Markus, Captain Ed Friend, Attorney Richard Nussbaum, James Wensits, Dick Maginot, and Kathleen Cekanski-Farrand. Councilman Zakrzewski noted that the purpose of the meeting was to continue to discussion with regard to Bill No. 74-88 which addressed truck routes. Councilman Zakrzewski then highlighted the changes in the proposed revision. He noted that pick-up trucks typically weigh approximately 8, 600 pounds and step vans are 10,000 pounds or more. Councilman Luecke questioned whether the trash trucks are exempted from the ordinance. Councilman Zakrzewski noted that a separate section which is not being amended in the Bill exempts such trash trucks. A revised copy of the Bill dated 10-40-88 was given to each of the Council members present. City Attorney Richard Nussbaum complimented Councilman Zakrzewski with regard to his effort on the Bill. He noted that several of the recommendations made by Corporal Stoynoff had been included. He believed that the overall Bill was enforceable. Mr. Ken Fedder questioned the wording on page 4, section 20- 8 (c) (1) and noted that the language does not address the situation where a pick-up document would be given to the driver upon pick-up. The Council Attorney, then read proposed amendatory language (copy attached) which Mr. Fedder believed would address the situation properly. Councilman Coleman also questioned whether amendments would be in order to the definition of truck on page one. Considerable discussion took place with amendatory language being discussed and approved by the Committee. (copy attached) Councilman Niezgodski stated that officers should have discretion and should use common sense with regard to enforcement of the ordinance.
