Zoning and Vacation Committee 10-10-88 Page 3 <br /> Councilman Luecke questioned the vacation procedures. The <br /> Council Attorney noted that a clear and consistent procedure <br /> must be established by the Council. In this particular <br /> situation both of the proposed vacations are being requested <br /> by the same individuals whereas the next vacation would have <br /> different ownership interest involved. <br /> The Council Attorney noted that both Bills could go forward <br /> this evening with proper amendatory language being <br /> incorporated in each. She further indicated that she would <br /> prepare such amendatory language for this evening's meeting <br /> (copy attached) . <br /> Following further discussion, Councilman Luecke made a <br /> motion seconded by Councilman Coleman that the proposed <br /> amended version of Bill No. 83-88 be recommended favorably <br /> to Council. The motion passed. <br /> Following further discussion, Councilman Luecke made a <br /> motion seconded by Councilman Coleman that the proposed <br /> amendatory version of Bill No. 84-88 be recommended <br /> favorably to Council. The motion passed. <br /> The Committee then reviewed Bill No. 85-88 which would <br /> vacate the north 212 feet of the first north-south alley <br /> east of Michigan and the east 165 feet of the first east- <br /> west alley north of Marion. Mr. Joseph Amaral represented <br /> the petitioners. He noted that the petitioners are Memorial <br /> Health Properties, Inc. and the City of South Bend for the <br /> use and benefit of the South Bend Economic Development <br /> Commission. He noted that currently there is an agreement <br /> that Memorial Health Properties, Inc. will become the <br /> overall purchaser and land owner through a lease purchase <br /> agreement. The Redevelopment Commission will be acting upon <br /> a proper resolution. He noted that the proposed vacation <br /> received a favorable recommendation from the Board of Public <br /> Works. He further noted that he had had several <br /> neighborhood meetings and that Councilmen Duda, Coleman, and <br /> Luecke had been in attendance in those meetings. He further <br /> stated that there was no known remonstrance at this time. <br /> Mr. Amaral further stated that the purpose of the vacation <br /> is to permit the construction of a daycare center which <br /> would be operated eventually by LaPetite. <br /> Councilman Luecke stated that the neighborhood had been very <br /> supportive and that he was personally supportive of the <br /> proposed vacation. Council Member Duda also gave supporting <br /> comments as well as Council Member Puzzello. <br />
