Alum tllrt rpurt <br /> • <br /> Oa hit Mammon Mound! atilt Mug of ecauth Nutt: ZONING AND VACATION COMMITTEE <br /> The April 24 , 1984 meeting of the Zoning and Vacation Committee <br /> was called to order by its Vice-Chairman Councilman Thomas Zakrzewski at <br /> 4: 45 p.m. in the Council Informal Meeting Room. <br /> Persons in attendance included Councilmen: Braboy, Puzzello, <br /> Paszek, Zakrzewski, Crone, Beck, Serge, _ and Taylor; Douglas Carpenter, <br /> Sheryl Bressler, Jim Wensits, John Leszczynski and Kathleen Cekanski-Farrand. <br /> Councilman Zakrzewski noted that he had called the meeting since <br /> Councilman Voorde would not be back in the City until this evening' s Council <br /> meeting. <br /> The Committee then discussed Bill No. 34-84 which would vacate <br /> an alley near Monroe Street. The petitioners include Dainty Maid Bake Shope, <br /> Hablin Company, Inc. and Jack Schmidt of Crescent Realty. It was noted .that <br /> the Board of Public Works gave a favorable recommendation to the alley vacation <br /> at its meeting of April 16 , 1984 subject to the City being provided the needed <br /> right of way to allow traffic to turn at the intersection of the T-alley <br /> created by this vacation and to any any all utility easements . <br /> Councilman Crone asked who enforces such conditions and was advised <br /> that they. should be made a part of the ordinance. The Council Attorney agreed <br /> to draft the necessary amendatory language to Section V of the Ordinance to <br /> make the ordinance effective after compliance with the conditions set forth by <br /> the Board. <br /> Following further discussion, Councilman Serge made a motion seconded <br /> by Councilman Puzzello that Bill No. 34-84 as amended be recommended favorably. <br /> to Council. The motion passed unanimously. <br /> The Committee then reviewed Bill No, 35-84 which would vacate <br /> approximately 390 feet of Butternut Road south of Lathrop.: St. ,The petitioner <br /> was the St. Joseph County Airport Authority. The vacation would allow all <br /> airport property to be contained within one fenceline. Mr. Leszczynski <br /> noted that the Board of Public Works gave a favorable recommendation with no <br /> conditions attached. Councilman Serge then made a motion seconded by Councilman <br /> Beck that Bill No 35-84 go to Council favorably. The motion passed unanimously <br /> The Committee then reviewed Bill No 36-84 which would vacate <br /> the first east-west alley north of Hastings Street which is in the Third <br /> District. The petitioners are residents of the area who desire the vacation <br /> to insure the safety of senior citizens and children in the area. It was <br /> noted that when the Ironwood Grand Trunk Railroad Crossing is, blocked a <br /> traffic hazard is created by drivers driving into the east end of the alley <br /> thinking they can continue north to Jefferson. <br /> Councilman Beck noted that all of the residents within the area <br /> had been contacted except for one individual who is presently in Florida. She <br /> also noted that a revised petition in favor of the vacation has also been <br /> prepared by the residents. Approximately five property holders have garages <br /> .affected by this alley and it was uncertain whether people north of the area <br /> would have, problems by the vacation. Mr. Leszczynski noted that the Board of <br /> Public Works sent the Bill to Council without recommendation. Following further <br /> ••l( ..f.. . .V•LLMIM. CO. <br />
