Olnmmtttrr rpnrt <br /> iIJn the mammon tlounrU of the elitg of'oath lino): COMMITTEE OF THE WHOLE <br /> The October 7, 1982 meeting of the Committee of the Whole was <br /> called to order by Councilman John Voorde at 4: 00 in the Council informal <br /> meeting room. <br /> Persons in attendance included: Councilmen Beck, Voorde, Crone, <br /> McGann, Szymkowiak, Zielinski, Taylor and Harris, John Peddycord, Carolyn <br /> Pfotenhauer, Eugenia Schwartz, Sherrie Petz, Katherine Barnard, Kathleen <br /> Cekanski-Farrand and members of the news media. <br /> Councilman Voorde noted the receipt of the October 6th memo <br /> from the Mayor stating that representatives from Crowe Chizek would be <br /> unavailable to give further explanation of the proposed office automation <br /> system, at today' s meeting. <br /> Councilman Voorde then noted that Kathy Barnard had requested .a <br /> few moments to update the Council on the enforcement of the Auto Service <br /> Center Ordinance. Mrs. Barnard then passed out a memo (attached) which <br /> showed that 42 applicants are in compliance with the ordinance, 21 applicants. <br /> would need to erect fences, 2 applicants do not comply with fire safety <br /> regulations, and 70 have not returned their applications. She also passed out <br /> pictures of various locations which would require fencing. Carolyn Pfotenhauer <br /> then passed out a letter indicating various areas of suggested changes to <br /> Ordinance No. 7058-82 dealing with automotive repair and service centers. <br /> (Attached) <br /> Mr. Peddycord, an attorney representing the Automotive Service <br /> :Cbuncil of Indiana and Mr. Robert Palmer were then called upon. Mr. Peddycord <br /> stated that he would prefer to work out a compromise rather than bring a <br /> lawsuit. He further indicated that he sees the City using licensing to deal <br /> with problems which are actually zoning and nuisance related. <br /> Mrs. Barnard stated that her department has learned alot over the <br /> past month and that the time was well spent. There are approximately 20-30 <br /> chronic problem areas which will have to be dealt with.. Several Councilmen <br /> asked questions with regards to the ordinance. The Council Attorney then <br /> suggested that she would meet with Mr. Peddycord and a representative of the <br /> City Attorney' s office. to disucss the alleged problem areas. She will then <br /> report back to the Council with an update. <br /> The Committee then turned to review Bill No. 76-82. A substitute <br /> verison of the Bill was passed out by Eugenia Schwartz. She highlighted the <br /> various changes that were made which were suggested at the last meeting of <br /> the Committee of the Whole. <br /> Councilman Crone suggested that committees or commissions serve at <br /> the pleasure of the appointing bodies. It was noted that the Area Plan Commiss• <br /> ion and the Older Adults Commission presently emcompasses such language, and <br /> that such language should be incorporated into the Energy Conversation Commissil <br /> and. the Traffic Commission. A considerable amount of disucssion followed, <br /> but there was an overall consensus to include such language. Mr. Schwartz <br /> was to check into the Civic Center Board of Managers, to see if such language <br /> could also be included there. <br /> Iw[[ /w[N alefr PURU•Miwo CO. <br />
