767 <br />Tuesday August 20th, 1907. <br />SCOTT STREET. <br />Hearing given on Condemnation Resolution No. 35, appropriating the following <br />described property: <br />Begin at the south east corner of lot 7 Raff's lst addition; thence east 20 feet; <br />thence south to the south line of Terre Haute & Logansport R. R. Right of Way; thence <br />north westerly on said south line of Right of Way to the west line of Scott street; <br />thence north to the place of beginning. <br />In the above matter no remonstrators appeared and no remonstrances were filed. <br />The Board therefore declare the above described property in all things condemned <br />and appropriated f'or public use. <br />Enineer filed rolls showing awards of damages and assessment of benefits,in the <br />matter of the opening of Chapin street; Catalpa avenue, Kendall street & Scott street <br />acro-s the tracks of the St. Joseph, South Bend & Southern Railroad. Under <br />Condemnation Resolutions Nos. 329_33, 34 &35 respectively. <br />The Board haVing'fully considered said matter decide that the damages and benefits <br />are equal and that none of the real estate mentioned in the Assessment rolls herein <br />is specially benefitted or damaged and the said Assessments Rolls are here -upon adopted. <br />It is further ordered that notice of such awards of -damages and assessment of <br />benefits be served, by the Police Department, according to law, and that a hearing <br />be had on September 4th, 1907, at 10 A. M., for the purpose of hearing or receiving <br />objections from any person or persons intereseted in said matter. <br />The Board having fully considered the matter of awards and damages in the matter of <br />the opening of Kline street, under Condemnation Resolution No. 31, it is held that the <br />benefits and damages are equal and that none of the real estate mentioned in the assess- <br />ment roll herein is specially benefitted or damaged and the said assessment roll is <br />hereupon adopted. <br />It is further ordered that notice of such awards of damagel$ and assessment of <br />benefits be served by the police department, according to law, and that a hearing <br />be had on September 4th, 1907, at 10 A. M., for the purpose of hearing or receiving <br />objections from any person or persons interested in or affected by such matter. <br />The Board having fully considered the matter of awards and damages in the opening <br />of Olive street, under Condemnation Resolution No. 302 it is held that the benefits and <br />damages are equal and that none of the'reai estate mentioned in the assessment roll <br />herein is specially benefitted or damaged and that the said assessment roll is her* <br />upon adopted. <br />It is further ordered that notice of such awards of damages and assessment of <br />benefits be served by the Police Department, according to law, and that a hearing be <br />had on September 4th, 1907, at 10 A. M. , for the purpose of hearing or receiving <br />objections.form any person or persons interested in or affected by said matter. <br />IMPROVEMENT RESOLUTION NO. 502. <br />Resolved by the Board of Public Works of the City of South Bend, Indiana: That an <br />lmprovement.be made of the kind, size, location and terminal points as follows: Bkgde, <br />Curb---kcW&lk on Leon Court from Catalpa avenue to Kendall street. Said improvement shall <br />be known and designated as "THE LEON..COURT GRADE CURB,& WALK IMPROVEMENT; and shall be <br />constructed according to the plans and specifications prepared by the City Civil Engineer°, <br />filed herewithr Notice of this resolution shall be'pubiished on the 21st day of Aug <br />and on the 28th day of August, 1907,." the South Bend Daily Times. This Board will <br />give a hearing on this resolution at .its office in the City.Hall on the-3rd day of <br />September 1 0 <br />P 9 7: at 7:15 P. M. - - <br />A Bond or Bonds to be issued to the Contractor in payment for such work where the <br />property owner signs waiver required,. as,aceording to law.
