<br />2 of 3 Appendix “A” <br />Work, since these are solely the Contractor’s rights and responsibilities under the <br />Contract Documents. <br />ii) The ENGINEER shall report to the OWNER known deviations from the Contract <br />Documents and from the most recent construction schedule submitted by the <br />Contractor. However, ENGINEER shall not be responsible for the Contractor’s <br />failure to perform the Work in accordance with the requirements of the Contract <br />Documents. The ENGINEER shall not have control over or charge of, and shall <br />not be responsible for acts or omissions of the Contractor, Subcontractors, or <br />their agents or employees, or of any other persons or entities performing <br />portions of the Work. <br />iii) Review testing procedures of Contractor’s Independent Testing Agency for <br />accuracy and completeness. <br />iv) Accompany visiting inspectors, representing Local, State, or Federal Agencies <br />having jurisdiction over the project, and report details of such inspections to the <br />OWNER. <br />10. The ENGINEER shall consider and evaluate for the OWNER the Contractor’s suggestions <br />regarding any modifications within the contract drawings and/or specifications and <br />report them with recommendations to the OWNER. <br />11. The ENGINEER shall provide the following in regards to standard construction <br />engineering records: <br />i) Prepare and maintain at the job site orderly files of correspondence, report of <br />job conferences, shop drawings and other submissions, reproductions or original <br />Contract Documents, including all addenda, change orders, and additional <br />drawings subsequent to the award of the Contract, progress reports and other <br />project related documents. <br />ii) Keep a diary or logbook, recording hours on the jobsite, weather conditions, list <br />of visiting officials, decisions, general observations, and specific observations <br />with regard to test procedures. Upon request, furnish copies of such a diary or <br />logbook to the OWNER. <br />iii) Maintain for the OWNER a record of names, addresses, and telephone numbers <br />of all subcontractors and major material suppliers. <br />iv) Prepare the Final Construction Record and Final Estimate as required by the <br />OWNER. <br />v) Furnish to the OWNER at periodic intervals, as required, progress reports of the <br />project, including the Contractor’s compliance with approved construction <br />schedules. <br />vi) Prepare progress estimates for periodic partial payments to the Contractor and <br />deliver to the OWNER for review and processing. The payments to the <br />Contractor will be based on estimates of the value of work performed and <br />materials complete in place in accordance with the contract. <br />vii) The Resident Project Representative will be responsible for the documentation of <br />pay quantities and estimates, and the maintenance of appropriate records <br />related to the construction of the project. <br />viii) The ENGINEER’s crew will be required to regulate their work week to conform to <br />the Contractor’s hours in accordance with the directions of the OWNER. In the <br />event the Contractor(s) schedules double shifts and/or night work on an <br />extensive basis to meet or accelerate his work effort, the ENGINEER’s total not to <br />exceed fee may require adjustment as necessary.
