The observer must request the employee to raise his or her shirt, blouse, or dress/skirt, as <br />appropriate, above the waist; and lower clothing and underpants to show you, byturning around, <br />that they do not have a prosthetic device. After the observer has determined that the employee <br />does not have such a device, you may permit the employee to return clothing to its proper <br />position for observed urination. <br />The observer must watch the employee urinate into the collection container. Specifically, they <br />are to watch the urine go from the employee's body into the collection container. <br />The observer but not the collector, must not take the collection container from the employee, but <br />must observe the specimen as the employee takesit to the collector. <br />The collector, when someone else has acted as the observer, must include the observer's name <br />in the "Remarks" line of the CCF (Step2). <br />If the employee declines to allow a directly observed collection required or permitted under this <br />section to occur, this is a refusal to test. <br />Shy Bladder Procedure <br />If the employee cannot provide a specimen at the initial attempt, the employee will be urged to <br />drink up to 40 oz. of water. The amount of water is to be spaced out over a three hour period. <br />The employee is not required to drink the water by49 CFR Part 40 regulations. <br />If the employee refuses to make the attempt to provide a new urine specimen or leaves the <br />collection site before the collection process is complete, the collection is discontinued, and the <br />Collectorshall note thefact on the "Remarks" line of the CCF(Step 2), and immediately notifythe <br />DER. This is a refusal to test and is considered a violation of the DOT regulations. <br />If the employee has not provided a sufficient specimen within three hours of the first unsuccessful <br />attempt to provide the specimen, the collection will be discontinued, noted on the "Remarks" line <br />of the CCF (Step 2), and the DER will be contacted immediately bythe collection site. <br />The DER will, after consulting with the MRO, direct the employee to obtain, within five days, an <br />evaluation from a licensed physician, acceptable to the MRO, who has expertise in the medical <br />issues raised bythe employee's failure to provide a sufficient specimen. (The MRO may perform <br />this evaluation if the MRO has appropriate expertise.) <br />If there is a valid medical reason, the test result will be changed by the MRO to "Cancelled." If <br />there is not an adequate basisfor determining that a medical condition has, or with a high degree <br />of probability could have, precluded the employee from providing a sufficient amount of urine, <br />the MRO, will issue a "Refusal to Test". <br />Breath Alcohol Test <br />All tests for breath alcohol will be conducted using a National Highway Traffic Safety <br />Administration (NHTSA) approved Evidential Breath Testing (EBT) device.
