RESOLUTION NO. 180 <br />A RESOLUTION OF THE SOUTH BEND <br />REDEVELOPMENT AUTHORITY <br />AUTHORIZING THE TRANSFER OF REAL PROPERTY TO <br />SOUTH BEND REDEVELOPMENT COMMISSION <br />WHEREAS, the South Bend Redevelopment Authority (the "Authority") exists and <br />operates under the provisions of I.C. 36 -7 -14.5. as amended from time to time, and is a body <br />corporate and politic; and <br />WHEREAS, pursuant to I.C. 36- 1 -11 -8, the Authority, may transfer or exchange <br />property with another governmental entity upon terms and conditions agreed upon by the two (2) <br />entities as evidenced by the adoption of substantially identical resolutions of each entity: and <br />WHEREAS, the South Bend Redevelopment Commission (the "Commission "). the <br />governing body of the South Bend, Indiana, Department of Redevelopment (the "Department") <br />and of the Redevelopment District of the City of South Bend, Indiana (the "Redevelopment <br />District'), exists and operates under the provisions of I.C. 36 -7 -14. as amended from time to time <br />(the "Act") and is a body corporate and politic; and <br />WHEREAS, the Authority is the owner of certain real property as set forth in Exhibit <br />"A "attached (collectively referred to as the "Property'); and <br />WHEREAS, the Department. by and through the Commission, has presented to the <br />Authority, a request for the transfer to the Commission of the Property; and <br />WHEREAS, the Authority, desires to transfer the Property to the Commission for the <br />redevelopment purposes of the Commission; and <br />WHEREAS, the Authority desires to authorize the staff of the Department to approve <br />and execute all documents necessary to effect the transfer of the Property; and <br />WHEREAS, the Department, through the Commission, will adopt a resolution consistent <br />with the requirements of I.C. 36- 1 -11 -8. <br />NOW, THEREFORE, BE IT RESOLVED BY THE SOUTH BEND <br />REDEVELOPMENT AUTHORITY AS FOLLOWS: <br />I. The transfer of the following described real property situated in St. Joseph <br />County, Indiana: <br />See Exhibit "A" <br />by the Authority to the Commission, without consideration, shall be, and hereby is, approved and <br />
