RESOLUTION NO. 17-01 <br />A RESOLUTION OF THE HISTORIC PRESERVATION <br />COMMISSION OF SOUTH BEND AND ST. JOSEPH COUNTY, INDIANA <br />QUALIFYING ADMINISTRATIVE APPROVAL ITEMS FOR ROUTINE <br />MAINTENANCE EXCLUSIONS <br />WHEREAS, the Historic Preservation Commission of South Bend and St. Joseph <br />County, Indiana (the "Commission") exists and operates under Article 13, Section 21-13 of the <br />South Bend Municipal Code and Chapter 154, Section 246, et. seq. of the St. Joseph County, <br />Indiana Code of Ordinances ("Enabling Ordinances"); and <br />WHEREAS, these Enabling Ordinances establish the powers and duties of the <br />Commission, which include the power to oversee modifications performed on designated <br />Landmarks and Historic Preservation Districts through the Certificate of Appropriateness <br />("COA") review process; and <br />WHEREAS, the Commission shall issue a COA prior to the construction, <br />reconstruction, alteration, demolition or moving of any exterior feature of any building, <br />structure or use; and <br />WHEREAS, the Enabling Ordinances direct the Commission to adopt bylaws for <br />carrying out its powers and duties, which include the aforementioned COA process; and <br />WHEREAS, Article 9.5, Section 1 ("Staff Procedures") of the Commission Bylaws <br />authorize staff to determine if applications are exempt from COA review for work limited to <br />the ordinary maintenance and repair of any building, structure or use which will not involve a <br />change in any exterior features of the property; and <br />WHEREAS, the Bylaws Article 2, Section 3a ("Code of Ethics — Responsibility to the <br />Community") encourages that the Commission and its designated Staff representatives <br />continually evaluate and update theirs plans, guidelines and procedures to ensure they meet the <br />community's current and future needs. <br />NOW, THEREFORE, BE IT RESOLVED BY THE HISTORIC PRESERVATION <br />COMMISSION OF SOUTH BEND AND ST. JOSEPH COUNTY AS FOLLOWS: <br />I.
