RESOLUTION NO. 17-01 A RESOLUTION OF THE HISTORIC PRESERVATION COMMISSION OF SOUTH BEND AND ST. JOSEPH COUNTY, INDIANA QUALIFYING ADMINISTRATIVE APPROVAL ITEMS FOR ROUTINE MAINTENANCE EXCLUSIONS WHEREAS, the Historic Preservation Commission of South Bend and St. Joseph County, Indiana (the "Commission") exists and operates under Article 13, Section 21-13 of the South Bend Municipal Code and Chapter 154, Section 246, et. seq. of the St. Joseph County, Indiana Code of Ordinances ("Enabling Ordinances"); and WHEREAS, these Enabling Ordinances establish the powers and duties of the Commission, which include the power to oversee modifications performed on designated Landmarks and Historic Preservation Districts through the Certificate of Appropriateness ("COA") review process; and WHEREAS, the Commission shall issue a COA prior to the construction, reconstruction, alteration, demolition or moving of any exterior feature of any building, structure or use; and WHEREAS, the Enabling Ordinances direct the Commission to adopt bylaws for carrying out its powers and duties, which include the aforementioned COA process; and WHEREAS, Article 9.5, Section 1 ("Staff Procedures") of the Commission Bylaws authorize staff to determine if applications are exempt from COA review for work limited to the ordinary maintenance and repair of any building, structure or use which will not involve a change in any exterior features of the property; and WHEREAS, the Bylaws Article 2, Section 3a ("Code of Ethics — Responsibility to the Community") encourages that the Commission and its designated Staff representatives continually evaluate and update theirs plans, guidelines and procedures to ensure they meet the community's current and future needs. NOW, THEREFORE, BE IT RESOLVED BY THE HISTORIC PRESERVATION COMMISSION OF SOUTH BEND AND ST. JOSEPH COUNTY AS FOLLOWS: I.
