tCommitt1 Ittport <br /> Zoning anb Thintsation tontinittia <br /> The July 14, 2003 meeting of the Zoning and Annexation Committee was called to order by its <br /> Chairperson, Council Member Ervin Kuspa at 3:40 p.m. in the Council Informal Meeting Room. <br /> Persons in attendance included Council Members Aranowski, Coleman, Varner, Kirsits, Kuspa, <br /> White, Pfeifer, and King; Joe Heintzelman, Andy Videkovich, Ray Simmons, Kevin Sullivan, <br /> Terry Harlan, Mike Stack, Michael Urbanski, Terry Bland of the goOttth 3 ti ' ribtttt and <br /> Council Attorney Kathleen Cekanski-Farrand. <br /> Council Member Kuspa noted that the Committee consists of Council Members Kelly, Varner, <br /> Coleman and himself. <br /> Council Member Kuspa called for a presentation on Bill No. 39-03 which would amend Chapter <br /> 21 of the South Bend Municipal Code by revising Article 10 addressing Sign Regulations. <br /> Andy Videkovich an Area Plan staff member made the presentation. He noted that Bill No. 39-03 <br /> was initiated by the Area Plan Commission. The Area Plan Commission held a public hearing on <br /> the proposed Bill on June 17, 2003 and sends the Bill to the Council with a favorable <br /> recommendation. The Bill would revise and limit the size, separation distance and display area of <br /> outdoor advertising signs within "IP" Industrial Park Zoning Districts. The restrictions would be <br /> the same in all districts where permitted. <br /> No one from the public spoke in favor or against Bill 39-03. <br /> Following discussion, Council Member Coleman made a motion, seconded by Dr. Varner that Bill <br /> No. 39-03 be recommended favorably to Council. The motion passed. <br /> Council Member Kuspa called for a presentation on Bill No. 40-03 which would amend Chapter <br /> 21 of the South Bend Municipal Code by revising Article 6,Division 2, to allow pool and billiard <br /> halls as a special exception in the "C" Commercial, "D" Light Industrial, and"E" Heavy Industrial <br /> Districts. <br /> Andy Videkovich an Area Plan staff member made the presentation. He noted that Bill No. 40-03 <br /> was initiated by the Area Plan Commission. The Area Plan Commission held a public hearing on <br /> the proposed Bill on June 17, 2003 and sends the Bill to the Council with a favorable <br /> recommendation. The Bill would permit pool and billiard halls as a controlled use but would <br /> require a special exception to be filed through the Board of Zoning Appeals and the Common <br /> Council in order for any to be located within 1,000 feet of any two(2) other controlled uses. <br /> Council Member King noted that the Bill would permit billiard halls to be located by family <br /> restaurants on a case by case basis. <br /> Council Member Kuspa then opened the meeting to comments in favor of Bill No. 40-03. Joe <br /> Heintzelman noted that approximately 6 1/2 years ago he opened Oscar's which was a Victorian <br /> Era Billiard Parlor. He had over 200 people who participated in billiard leagues with the primary <br /> age group being between 25-45 years of age. He noted that his company held tournaments which <br /> benefitted such groups as the Diabetes Association. His establishment was a place where people <br /> could come and enjoy themselves in an establishment with a good reputation. Because of the <br /> hospital purchasing the building he is in the process of relocating his business. <br />
