Commft /a Zeport <br /> zoning anti tnniacattou touttaittor <br /> The October 13, 2003 meeting of the Zoning and Annexation Committee was called to order by its <br /> Chairperson, Council Member Ervin Kuspa at 4:00 p.m. in the Council Informal Meeting Room. <br /> Persons in attendance included Council Members Aranowski,Kelly, Pfeifer,King, Varner, White, <br /> Kirsits,Coleman and Kuspa;City Controller Rick 011ett, Planner Jeff Meyer, Pam Meyer, Michael <br /> Danch,and Council Attorney Kathleen Cekanski-Farrand. <br /> Council Member Kuspa noted that the Committee is composed of Council Members Kelly, Varner, <br /> Coleman and himself. <br /> Council Member Kuspa called for a presentation on Bill No. 03-108(copy attached) which would <br /> adopt a written fiscal plan and would establish a policy for the provision of services to an area in <br /> German Township commonly known as the "Olive Road 3 Annexation Area". There was no <br /> presenter available from the City Administration. <br /> Council Member Kuspa then called for a presentation on Substitute Bill No. 73-03 which would <br /> annex certain land in German Township commonly known as Olive Road 3, 52600 and 52650 <br /> Olive Road(copy attached). There was no presenter available from the City Administration. <br /> Council Member Kuspa then called for a presentation on Bill No. 61-03 which is a rezoning <br /> request for the property located at 4005 Portage Road(copy attached). <br /> Jeff Meyer,a Planner with Area Plan reported that the Area Plan Commission held a public hearing <br /> on this bill on September 16, 2003 and send it to the Council with a favorable recommendation <br /> (copy attached). <br /> Michael Danch of Danch, Harper and Associates with offices at 2422 Viridian Drive, Suite 201, <br /> South Bend, Indiana 46628 made the presentation on behalf of the petitioners Salah and Cynthia <br /> Hilal who are the property owners. Mr. Danch provided a preliminary site plan to the Committee <br /> (copy attached). He noted that the area in question contains six (6) acres which is located on the <br /> west side of Portage. Three (3) types of land uses are proposed namely "C" commercial, "0" <br /> Office and multi-family. He summarized the location of each proposed used on the preliminary site <br /> plan and noted that forty(40) townhouses are proposed along with a potential restaurant. He noted <br /> that at the Area Plan Commission meeting that the owners of the property to the south of the <br /> petitioned area inquired about the overall process involved. <br /> Council Member King noted that the property owners did not speak in opposition to the Bill at the <br /> Area Plan Commission meeting. <br /> Council Member Aranowski noted that a home is currently located on the property. Mr. Danch <br /> stated that it would be removed along with the out buildings. Mr. Danch further noted that mr. <br /> Hilal's brother has recently purchased the property to the north, and added that Community Wide <br /> Credit Union is currently looking for"0" Office space in this area. <br /> Council Member Coleman inquired about de-exceleration and exceleration lanes. Mr. Danch stated <br /> that City Engineer Carl Littrell is study that issue currently and that it would be addressed on the <br /> final site plan. <br /> Following discussion, Council Member Coleman made a motion, seconded by Council Member <br />
