TABLED - PETITION TO VACATE THE ALLEY AT 2234 HIGHLAND AVE. NORTHERN BORDER OF PROPERTY BEGINS AT PHILIPPA AND DEAD -ENDS AT HIGHLAND AVE. ON WESTERN BORDER Ms. Maradik indicated that Ms. Kathleen A. Kershner, 2234 Highland Ave., South Bend, IN 46613, submitted a request to vacate the above referenced alley. Ms. Maradik advised the Board is in receipt of unfavorable recommendations concerning this Vacation Petition from the Street Department, Fire Department, Police Department. Community Investment, and Engineering state the request does not meet three of the four (1, 2, 4) criteria of I.C. 36-7-3-13. However, Ms. Maradik added that upon further review of the documentation, the radius map included in the City's review packet was inaccurate; therefore, the wrong location for the vacation was reviewed and recommended upon. Ms. Maradik suggested tabling the matter to confirm the correct location of the property and allow for proper review of the item. Petitioner Kathleen Kerschner was present at the meeting and confirmed that the City's map is erroneous and that she is requesting to vacate property parallel to her own. Ms. Maradik and Ms. Kerschner agreed to clarify and confirm the location requested following the meeting, followed by circulation of an updated packet to City staff for review. The item will then be added to the agenda for the next Board meeting. Mr. Gilot also noted for the record that County Councilmember Derek Dieter had been at the meeting and had indicated his support for the request. Therefore, Mr. Molnar made a motion to table the request for the July 27`h meeting. Mr. Gathers seconded the motion, which carried by roll call. APPROVE/DENY TRAFFIC CONTROL DEVICES Upon a motion made by Mr. Molnar, seconded by Mr. Gathers and carried by roll call, the following traffic control device request was approved: NEW INSTALLATION: Temporary Reserved Handicapped Accessible Parking Space Sign LOCATION: North Side of Jefferson Blvd. East of Lafayette Blvd., #3 REMARKS: All Criteria Met APPROVE CONSENTS TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE Ms. Maradik stated that the Board is in receipt of the following Consents to Annexation and Waivers of Right to Remonstrate. The Consents indicate that in consideration for permission to tap into public water/sanitary sewer system of the City, to provide water/sanitary sewer service to the below referenced properties, the applicants waive and release any and all rights to remonstrate against or oppose any pending or future annexations of the properties by the City of South Bend: A. Ms. Lori Miller, 17752 Darden Rd., South Bend, IN 46635 1. 17752 Darden Rd. — Sewer (Key No.002-2191-8787) B. Mr. Randy Polovick, 53021 Poppy Rd., South Bend, IN 46628 1. 53021 Poppy Rd. — Water/Sewer (Key No. 021-1037-059306) C. Mr. Jeffrey C. Beall & Katrina Higgins, 1302 N. Lafayette Blvd., South Bend, IN 46617 1. 60010 Mayflower Rd.— Water (Key No. 005-1038-0517) Upon a motion by Mr. Molnar, seconded by Mr. Gathers and carried by roll call, the Consents to Annexation and Waivers of Right to Remonstrate were approved as submitted. APPROVE RENEWAL OF WASTEWATER DISCHARGE PERMIT(S) In a Memorandum to the Board, Ms. Serena Lozano -Shane, Division of Wastewater, submitted the following Wastewater Discharge Permit(s) for renewal and recommended approval:
