June 15, 2021

City of South Bend Board of Public Works
227 West Jefferson
1316 County-City Building
South Bend, Indiana 46601

Re: Eddy Street Commons Signage Rebrand
Digital Kiosks

To Whom It May Concern:

At its June 8, 2021 meeting, the South Bend Board of Public Works approved Kite Realty
Group (“KRG”) to install digital kiosks at various locations within City R/W in Eddy
Street Commons subject to an agreement that details the kiosk advertising operations
being executed between KRG and the City. KRG then had an initial meeting with various
City departments, including Engineering, Department of Community Investment (DCI),
and Legal on June 14, 2021 to discuss terms of the agreement.

One item discussed at the initial meeting was timing of the installation. KRG and the City
would like to have construction/installation completed this summer before students return
to campus, in order to ensure safety of pedestrians and limit impediments in accessing
Eddy Street Commons businesses. Therefore, KRG is going to approve the sign vendor
to begin manufacturing the kiosks and digital screens while finalizing the agreement with
City staff in regards to the kiosk advertising components. KRG understands that
installation of the kiosks would be done at their own risk of not having an agreement in
place for how the kiosks would be used in an advertising capacity.
