Ordinance Amending Section 4-35 SBMC Addressing Massage Establishments&Therapy <br /> Page 4 <br /> (500) credit hours of classroom instruction in massage therapy and <br /> related training. <br /> (14) Sterilize means the use of a physical or chemical procedure to destroy all microbial <br /> life, including highly resistant bacterial endospores. <br /> (b) Exemptions from section. This section of the South Bend Municipal Code shall have no <br /> application to and no effect on the following: <br /> the State of Indiana, and physicians, surgeons, chiropractors, osteopaths or physical <br /> under their direction and control. <br /> (2) Barbershops and beauty parlors,barbers and beauticians licensed under the laws of <br /> the State of Indiana provided that such massage as is practiced is limited to the head and <br /> (3) Accredited schools and colleges and coaches and trainers therein while acting <br /> within the scope of their employment; and not for profit community supported <br /> agencies. <br /> (c) Massage establishment license required;procedure for filing application; issuance. It shall <br /> be unlawful for any person to engage in, conduct, or carry on, in or upon any premises within the City <br /> of South Bend the business of a massage establishment without a license issued pursuant to the <br /> provisions of this section for each and every such massage establishment. <br /> (1) Application; contents: <br /> a. An application for a license to operate a massage establishment shall be filed <br /> on or before February 28 of each calendar year with the Board of Public Works <br /> upon forms provided by the City Controller's Office, and such application shall <br /> be verified under oath. <br /> b.
