• <br /> • <br /> each calendar year and shall be able to accumulate a maximum <br /> of twenty-one (21) paid sick days in a sick leave bank. <br /> (e) The current sick leave buy-back program in effect <br /> shall continue in effect for sworn members and officers of <br /> the Fire Department with the specific details being set <br /> forth in the Collective Bargaining Agreement. Newly sworn <br /> members may not sell back sick days until a bank of ten (10 <br /> days are accrued. <br /> (f) The above terms shall be subject to approval by <br /> the Board of Public Safety. <br /> SECTION VII. FLSA, THE RIGHT TO ARBITRATE FLSA, QUINT- <br /> MIDI PAY, DEPARTMENT AND SHIFT STRENGTH, AND THE FITNESS AND <br /> WELLNESS PROGRAM <br /> (a) The foregoing pay and monetary fringe benefits <br /> provisions of this Ordinance were proposed and accepted in <br /> light of reaching specific agreements and understandings <br /> which affect particular sections of the Collective <br /> Bargaining Agreements of 1985 and 1986. <br /> (b) The City and the South Bend Firefighters <br /> Association, Local No. 362 agree to work together to prepare <br /> appropriate language to modify said Agreements in light of <br /> the understanding reached between them regarding the Fair <br /> Labor Standards Act (FLSA) , the Right to Arbitrate FLSA, <br /> Quint-Midi pay, Department and Shift Strength, and the <br /> Fitness and Wellness Program. More particularly the <br /> following articles shall be amended: <br /> 1. FLSA and Department and Shift Strength. <br /> Modification of Article 9 and 20 of the December <br /> 31, 1986 Collective Bargaining Agreement and the <br /> preparation of a new Memorandum of Understanding <br /> addressing an Advisory Labor Management Committee, <br /> 27-day work cycle, 212 sworn members, 64 24-hour <br /> personnel per shift, 55 24-hour shift strength, and <br /> 9 vacation groups. <br /> 2. The Right to Arbitrate FLSA. <br /> Deletion of Article 7 of the May 8, 1985 Collective <br /> Bargaining Agreement and paragraph 5 addressing <br /> said Article in the December 31, 1986 Memorandum of <br /> Understanding "Exhibit C" which is a part of the <br /> December 31, 1986 Collective Bargaining Agreement, <br /> all of which shall be null and void as of December <br /> 31, 1988. <br /> 3. Quint-Midi Pay. <br /> Deletion of Article 23 of the December 31, 1986 of <br /> the Collective Bargaining Agreement and shall be <br /> null and void as of December 31, 1988. <br /> 4. Fitness and Wellness Program. <br /> Preparation of a Memorandum of Understanding <br /> setting forth the details of the Fitness and <br /> Wellness Program whereby the City agrees to pay the <br /> sum of $150.00 per year to one of three facilities <br /> selected by the City. i.e. Health & Lifestyle <br />
