BILL NO. <br /> ORDINANCE NO. 7AW,2-ff t <br /> AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br /> BEND, INDIANA, AMENDING CHAPTER 21 OF THE MUNICIPAL CODE OF <br /> THE CITY OF SOUTH BEND BY AMENDING THE DEFINITION OF <br /> "FLOODPLAIN" <br /> STATEMENT OF PURPOSE AND INTENT <br /> A review was made of the City of South Bend's <br /> Floodplain Ordinance by the staff of the Division of Water, <br /> Indiana Department of Natural Resources of the State of <br /> Indiana. <br /> As a condition of continued eligibility in the National <br /> Flood Insurance Program, the City of South Bend has been <br /> directed to amend or supplement existing floodplain <br /> management measures to incorporate the modified flood <br /> regulations to comply with Section 60. 3 (d) of The National <br /> Flood Insurance Program Regulations. <br /> The following ordinance brings the City of South Bend <br /> into compliance with the federal requirements. <br /> NOW, THEREFORE, be it ordained by the Common Council of <br /> The City of South Bend, St. Joseph County, Indiana, as <br /> follows: <br /> SECTION I . Chapter 21, Article 1, Section 21-i of the <br /> Municipal Code of the City of South Bend, Indiana, is hereby <br /> amended by deletion of sub-section (a) (22 .5) in its <br /> entirety and by the substitution of new subsection (a) <br /> (22 .5) Which shall read in its entirety as follows: <br /> {a}{22-5} Floodplain-means-tie-area-adjoining-a-river <br /> ar-streamT-which-has-been-or-which-may-hereafter-be <br /> €leoded7-se-designated-in-tie-'!Fleed-Insurance-Study <br /> for-t ie-City-af-South-BendT-IndianaT!'-dated-February <br /> 17-19787-prepared-by-the-Federal-Insurance <br /> Administration: <br /> (a) (22 . 5) "Floodplain" means the area adjoining a <br /> river or stream which has been or which may here- <br /> after be flooded, so designated by the Federal <br /> Insurance Administration on the Flood Insurance Rate <br /> Maps, Flood Boundary and Flood Maps and Flood <br /> Insurance Study dated February 17, 1988, along with <br /> any subsequent revisions hereby adopted by reference. <br /> SECTION II . <br /> This Ordinance shall be in full force and effect from <br /> and after February 17, 1988, its passage by the Common <br /> Council, approval by the Mayor and publication as required <br /> by law. <br /> 'ember o the Common Council <br />
