the duty to comply with the applicable provisions set forth <br /> in this Article, as well as all state law requirements. <br /> However, those persons who petition pursuant to Section 2- <br /> 84, must only comply with the applicable state law <br /> provisions, and the requirements of Section 2-84 . 13 herein. <br /> Sec. 2-76.1 Definitions <br /> (a) As used in this Article, the terms and phrases <br /> shall have the following meanings: <br /> (1) "Available for use" shall mean publicly <br /> advertised at rates not to exceed Section 8 Rental <br /> Guidelines for the unit size. <br /> (2) "Central Business District (CBD)" shall mean <br /> the areas located within the City of South Bend as <br /> designated on the following map labeled Exhibit A-1, <br /> attached hereto and included herein, and as set forth by <br /> legal description in Exhibit A-2, which is incorporated by <br /> reference, with copies of same being kept on file in the <br /> Office of the City Clerk. <br /> (3) ',Designating body" shall mean the Common <br /> Council of the City of South Bend, Indiana. <br /> (4) "East Bank Development Area (EBDA)" shall <br /> mean the areas located within the City of South Bend as <br /> designated on the following map labeled A-3, attached hereto <br /> and included herein, and as set forth by legal description <br /> in Exhibit A-4 which is incorporated by reference, with <br /> copies of same being kept on file in the Office of the City <br /> Clerk. <br /> (5) "Economic Development Target Areas (EDTA)" <br /> shall mean the areas located within the City of South Bend <br /> which have been designated by the Economic Development <br /> Commission, as shown on the following map labeled Exhibit <br /> A-5, attached hereto and included herein, and as set forth <br /> by legal description in Exhibit A-6 which is incorporated by <br /> reference, with copies of same being kept on file in the <br /> Office of the City Clerk. A maximum of fifteen percent <br /> (15%) of the total geographic territory of the City may be <br /> designated as EDTA.2 <br /> (6) "Economic Revitalization Area (ERA)" shall <br /> mean an area which is within the corporate limits of the <br /> City which has become undesirable for, or impossible of, <br /> normal development and occupancy because of a lack of <br /> development, cessation of growth, deterioration of <br /> improvements or character of occupancy, age, obsolescence, <br /> substandard buildings, or other factors which have impaired <br /> values or prevent a normal development of property or use of <br /> property. The term economic revitalization area (ERA) shall <br /> also include: any area where a facility or a group of <br /> facilities that are technologically, economically, or energy <br /> obsolete are located and where the obsolescence may lead to <br /> a decline in employment and tax revenues; and a <br /> residentially distressed area, except as otherwise provided <br /> in I.C. 6-1. 1-12. 1-1 et seq. <br /> (7) "Employment Training Services (ETS)" shall <br /> mean Employment Training Services of St. Joseph County or <br /> its successor agency. <br />
