d) Any modern accouterments having printed matter on its surface <br /> shall also be treated as a sign in conformance with the regulations of <br /> Article 10 of this Chapter. <br /> e) Existing modern accouterments located within the. City as of the <br /> effective date of this. Ordinance shall not be limited by, governed by <br /> or otherwise affected by the provisions of this Division. <br /> f) Where there are practical difficulties or unnecessary hardships <br /> in complying strictly with the provisions of this Division, the Board <br /> of Zoning Appeals may, in specific cases, adjust any such condition in <br /> harmony with the general purposes and intents of this Chapter to the <br /> end that the public health., safety, aesthetics, and general welfare may <br /> be secured and substantial justice done. <br /> g) In the interpretation and enforcement of this Section, the main <br /> supporting structure of modern accouterments is the primary focus of <br /> location regulations set forth herein. <br /> ARTICLE 3 . NONCONFORMING. USES <br /> Sec. 21-37 . Nonconforming uses; existing; alterations; changes in <br /> districts. <br /> ( a) The lawful use of land existing at the time of the passage of <br /> this chapter, although such use does not conform to the provisions <br /> hereof, may be continued;-bit-if-sueh-neneenfermSng-use-is <br /> d4seent€nued;-any-€azure-use-a€-tbe-premises-shall-be-ln-eenfermlty <br /> with-the-provisions-ef-this-ehapter. However, when there has been a <br /> vacancy or cessation of operation of a nonconforming use for a period <br /> of twelve (12) months, the nonconforming use will be presumed to have <br /> been abandoned and such use shall not thereafter be re-established and <br /> use of the land shall conform to the provisions of this chapter. If <br /> the owner or occupant of a nonconforming use appeals from this <br /> presumption of abandonment to the Board, the burden of proving lack of <br /> abandonment rests on that owner or occupant. <br /> (b) The lawful use of a building existing at the time of the <br /> passage of this chapter may be continued, although such use does not <br />
