• <br /> Bill No. <br /> Ordinance No. $0.53-g9 <br /> AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY <br /> OF SOUTH BEND, INDIANA, ADDRESSING THE AMOUNTS OF <br /> BENEFITS TO BE RECEIVED BY SURVIVING SPOUSES OF <br /> DECEASED POLICE OFFICERS AND FIREFIGHTERS <br /> STATEMENT OF PURPOSE AND INTENT <br /> Several Indiana Laws govern pension funds and benefits <br /> for police officers and firefighters. More specifically the <br /> 1925 Police Pension Fund is addressed in Indiana Code <br /> Sections 36-8-6-1 et seq. , the 1937 Firefighters' Pension <br /> Fund is addressed in Indiana Code Sections 36-8-7-1 et seq. , <br /> and the 1977 Police Officers' and Firefighters' Pension and <br /> Disability Fund is addressed in Indiana Code Sections 36-8- <br /> 8-1 et seq. <br /> The Common Council and the City Administration have <br /> jointly worked together, and have determined to raise the <br /> benefits received by surviving spouses of deceased police <br /> officers and firefighters to thirty five percent (35%) of <br /> the salary of a first class police officer or firefighter. <br /> NOW, THEREFORE, BE IT ORDAINED by the Common Council of <br /> the City of South Bend, Indiana, as follows: <br /> SECTION I. If a sworn police officer or sworn <br /> firefighter of the City of South Bend, Indiana, dies while <br /> in active service or after retirement, the surviving spouse <br /> of said firefighter or police officer who dies before <br /> January 1, 1989, shall receive thirty five percent (35%) of <br /> the salary of a fully paid first class firefighter or first <br /> class police officer in the respective police or fire <br /> departments at the time of the payment of the pension. For <br /> the surviving spouse of such a firefighter or police officer <br /> who dies after December 31, 1988, an amount per month, <br /> during the spouse's life, shall be equal to the greater of <br /> thirty five percent (35%) of the monthly pay of a first <br /> class firefighter or police officer or fifty-five percent <br /> (55%) of the monthly benefit the deceased member was <br /> receiving or was entitled to receive on the date the <br /> member's death. <br /> SECTION II.
