Magliozzi <br />Executive Director Assistant Director <br />Phone 574 235 -9571 www. stiosephcountyindiana .com /areaplan Fax 574 235 -9813 <br />April 16, 2008 <br />The Honorable Council of the City of South Bend <br />4th Floor, County -City Building <br />South Bend, IN 46601 <br />RE: A proposed ordinance and site development plan of Barakeh Land Co., Inc, et al to zone from MR <br />Urban Corridor Multifamily District, LB Local Business District, and CB Community Business <br />District to CB Community Business District, property located at the southeast corner of Western <br />Avenue and Lombardy Drive lying immediately south of the intersection and immediately north of <br />450 Lombardy Drive, City of South Bend - APC# 2471 -08 <br />Dear Council Members: <br />I hereby Certify that the above referenced ordinance of Barakeh Land Co., Inc, et al was legally advertised <br />on Thursday, April 3, 2008 and that the Area Plan Commission at its public hearing on Tuesday, April 15, <br />2008 took the following action: <br />Upon a motion by John DeLee, being seconded by Karl King and unanimously carried, the <br />proposed ordinance and site development plan of Barakeh Land Co., Inc, et al to zone from <br />M171 Urban Corridor Multifamily District, LB Local Business District, and CB Community <br />Business District to CB Community Business District, property located at the southeast corner <br />of Western Avenue and Lombardy Drive lying immediately south of the intersection and <br />immediately north of 450 Lombardy Drive, City of South Bend is sent to the Common <br />Council with a favorable recommendation. The site was previously occupied by several <br />business and is located within a commercial area. The rezoning will redevelop what has <br />become a series of underutilized commercial parcels. The rezoning fits well with the existing <br />commercial uses to the north and west of the site. The rezoning will require several variances <br />to meet the City of South Bend Zoning Ordinance. <br />The deliberations of the Area Plan Commission and points considered in arriving at the above decision are <br />shown in the minutes of the public hearing, and will be forwarded to you at a later date to be made a part of <br />this report. <br />Sincerely, <br />w U(J- �vczti <br />W.
