SUBSTITUTE BILL NO. 9-91 <br /> ORDINANCE NO. % . 1- g\ <br /> AN ORDINANCE OF THE COMMON COUNCIL OF THE CITY OF SOUTH <br /> BEND, INDIANA, AMENDING CHAPTER 4, ARTICLE 4, SECTION 4-60 <br /> OF THE MUNICIPAL CODE OF THE CITY OF SOUTH BEND COMMONLY <br /> KNOWN AS "TRANSIENT MERCHANTS" . <br /> STATEMENT OF PURPOSE <br /> The City of South Bend in conjunction woth the Chamber <br /> of Commerce, passed Ordinance No. 8086-90 which amended the <br /> rules and regulations addressing transient merchants within <br /> the City. <br /> Surrounding communities have passed similar legislation <br /> in an attempt to set reasonable and enforceable regulations <br /> of such activity. <br /> During this Holiday Season however, it has been brought <br /> to the City's attention that vendors who wish to sell <br /> Christmas trees and wreaths for a limited period of time, <br /> are currently required to pay the sum of one thousand <br /> dollars ($1, 000. 00) if they desire to sell trees for more <br /> than fourteen (14) total days. The City believes that the <br /> current licensing fee amount creates an undue hardship, and <br /> therefore believes that an amendment to the fee is in order. <br /> NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE <br /> CITY OF SOUTH BEND, INDIANA, AS FOLLOWS: <br /> Section I. Chapter 4 , Article 4, Section 4-60 (f) of the <br /> Municipal Code of the City of South Bend, Indiana is hereby <br /> amended to read as follows: <br /> (f) License Fees <br /> (1) The license fees for transient merchants shall be <br /> as follows: <br /> (i) Three hundred fifty dollars ($350.00) for proposed <br /> business operations of three (3) consecutive days or <br /> less. <br /> (ii) Five hundred dollars ($500. 00) for proposed <br /> business operations of more than treee (3) consecutive <br /> days but less than fourteen (14) total days of <br /> operation. <br /> (iii) One thousand dollars ($1, 000. 00) for proposed <br /> business operations of more than fourteen (14) total <br /> days, but less than one (1) year of any licensing year. <br /> (iv) Thirty dollars ($30. 00) for proposed business <br /> operations during the months of November and/or <br /> December, which only sell live and/or natural <br /> Christmas trees and/or live and/or natural wreaths. <br /> Section II. This Ordinance shall be in full force and effect <br /> from and after its passage by the Common Council, approval <br /> by the Mayor, and legal publication. <br />
