City of South Bend Disparity Study 2020 <br />2. Utilization, Availability and Disparity Analyses for the City <br />Strict constitutional scrutiny requires that a local government limit its race - <br />based remedial program to firms doing business in its product and geographic <br />markets. CHA therefore analyzed the City's contract data for calendaryears <br />2015 through 2017. <br />We received a Final Contract Data File from the City which contained 278 con- <br />tracts, worth $103,162,022. Of these prime contracts, there were 327 associ- <br />ated subcontracts valued at $25,523,221. The Final Contract Data File was <br />used to determine the geographic and product markets for the analyses, and <br />to estimate the utilization and availability of M/WBEs by funding source and <br />contract type. <br />Table 1-1 presents the NAICS codes, the label for each NAICS code, and the <br />industry percentage distribution of spending across NAICS codes, by type of <br />contract.
