Following collection of the urine sample for drug <br />testing, the employee must be advised that they will be indefinitely suspended pending results of <br />this drug test and then be transported to his/her residence. The employee shall be permitted to <br />return to work and shall be paid wages for time lost if the lab results received are negative. <br />Compensation for lost time will not be granted if the conduct associated with the drug testing <br />warrants a suspension without pay for the term of the suspension. <br />Care shall be taken that no conclusions are stated by any member of management as to whether <br />or not an employee is a substance abuser; but only that, under the guidelines of the company’s <br />substance abuse policy, that the employee may be required to undergo these tests. <br />The employee must not be allowed to proceed alone to or from the collection site. In addition to <br />the safety concerns for the employee, accompanying the employee assures that there is no <br />opportunity to ingest anything to affect the outcome of the tests. If these tests are positive, the <br />employee shall make arrangements to be transported home and be instructed not to drive a motor <br />vehicle. If the employee insists on driving, the proper law enforcement agency may be notified <br />that an employee is leaving company premises driving a motor vehicle and may be under the <br />influence. <br />Return to Work Testing: <br />Any individual who has been suspended due to either drug or alcohol abuse shall comply with <br />the provisions stated in the policy statement at the start of this drug policy. The employee shall <br />be evaluated by a substance abuse professional and the cost of performing additional drug tests <br />are at the employee’s expense as previously indicated. <br />If a driver has had an alcohol test with a breath alcohol content of 0.04 or greater, they may not <br />return to work until they have completed a test producing a result of less than 0.02. There shall <br />be also at least six (6) follow-up tests in the first twelve months following a return to duty from <br />post substance abuse treatment. In both instances, follow-up testing may be completed without <br />prior notice for up to five years following his/her return to work. Once returned to work, the <br />employee enters into a Last Chance Agreement with Reynolds Construction and shall agree to <br />remain drug and/or alcohol free during his employment. Any subsequent confirmed positive test <br />result shall result in discharge. <br />TESTING PROCEDURES <br />Drug Testing: <br />Testing shall be performed utilizing urine samples. Testing will be performed by a laboratory <br />certified by the National Institute on Drug Abuse or an equivalent organization as determined by <br />the Company at its sole discretion. <br />Alcohol Testing: <br />In some instances, the company shall utilize law enforcement officers or some other organization <br />which has been certified by state or local governments to conduct breath alcohol tests as <br />qualified as breath alcohol technicians, in the absence of our breath alcohol technician. <br />WRITTEN SAFTEY PROGRAM Page | 240 <br /> <br />
