WHEREAS, Owner intends to submit and receive Secondary Plat approval granting the future Exhibit A; and NOW, THEREFORE, in consideration of the obligations, terms and conditions contained herein, and the above recitals, the adequacy of which consideration the parties expressly acknowledge, Owner and the City agree as follows: 1. Recitals The parties hereto acknowledge and agree that the foregoing recitals are incorporated herein as an integral part of this Agreement. 2. Future Extensions of Sanitary Sewer The Owner understands that all future extensions of public sanitary sewer beyond Phase 1A and Phase 1B shall be served by gravity sanitary laterals within the future R.O.W. 3. Construction Inspection The Owner has provided the City with Exhibit B, which depicts drawings of the Dedicated Improvements, which the City standards. The Owner shall allow the City to inspect the Dedicated Improvements during construction to ensure conformance to the agreed standards set forth in Exhibit B, in particular with regard to area planning, adequacy of design, and quality of construction. The Owner shall contact the City at least two (2) business days in advance to arrange for the attendance of a City inspector at key milestones throughout work within the future R.O.W. Key milestones shall include but are not limited to: hot mix asphalt placement, placement of any drainage apparatus, water main installation, concrete placement, light installation, and tree installation.
