WHEREAS, Owner intends to submit and receive Secondary Plat approval granting the <br />future Exhibit <br />A; and <br />NOW, THEREFORE, in consideration of the obligations, terms and conditions contained <br />herein, and the above recitals, the adequacy of which consideration the parties expressly <br />acknowledge, Owner and the City agree as follows: <br />1. Recitals <br /> The parties hereto acknowledge and agree that the foregoing recitals are incorporated <br />herein as an integral part of this Agreement. <br />2. Future Extensions of Sanitary Sewer <br />The Owner understands that all future extensions of public sanitary sewer beyond Phase 1A <br />and Phase 1B shall be served by gravity sanitary laterals within the future R.O.W. <br />3. Construction Inspection <br />The Owner has provided the City with Exhibit B, which depicts drawings of the Dedicated <br />Improvements, which the City standards. The Owner shall <br />allow the City to inspect the Dedicated Improvements during construction to ensure conformance <br />to the agreed standards set forth in Exhibit B, in particular with regard to area planning, adequacy <br />of design, and quality of construction. The Owner shall contact the City <br />at least two (2) business days in advance to arrange for the attendance of a City inspector at key <br />milestones throughout work within the future R.O.W. Key milestones shall include but are not <br />limited to: hot mix asphalt placement, placement of any drainage apparatus, water main <br />installation, concrete placement, light installation, and tree installation.
