DEDICATED IMPROVEMENTS AGREEMENT <br />nd <br />This Dedicated Improvements Agreement (the is made on this 22 day of <br />September 2020, by and between the City of South Bend, Indiana, an Indiana municipal <br />corporation , acting by and through its Board of Public Works (the "Board"), and GLC <br />Portage Prairie IV, LLC, an Indiana limited liability company with an address of 112 W. Jefferson <br />Blvd, STE. 200 South Bend IN 46601 (the construct dedicated <br />improvements in a future public right-of-way (future R.O.W.) <br />boundaries Project Area. <br />WHEREAS, Owner intends to develop approximately 119 acres of real estate located <br />within the City, as shown on the proposed Subdivision Plat attached hereto as Exhibit A and <br />incorporated herein by reference; and <br />WHEREAS, Owner has previously installed sidewalk, curb, landscaping, trees, drive <br />approaches, sanitary sewer, storm sewer, water main, hydrants, and asphalt pavement in future <br />Existing Improvements for Dedication <br />Exhibit B, attached hereto and incorporated herein by reference, which improvements are located <br />adjacent to Lot 1; and <br />WHEREAS, Owner intends to install sidewalk, curb, lighting, landscaping, trees, drive <br />approaches, sanitary sewer, storm sewer, water main, hydrants, and asphalt pavement in future <br />R.O.W. Future Improvements for Dedication and with the Existing Improvements for <br />) as more particularly described as Phase 1B in Exhibit <br />B; and <br /> <br />
