BACKGROUND AND RECORD. <br />Petitioner/Appellant NORTHERN INDIANA HISTORICAL SOCIETY, INC. D/B/A THE HISTORY <br />MUSEUM (the "Museum"), by counsel, pursuant to INDIANA CODE §§ 36-7-11-4 and 36-7-4-1, et <br />seq., and, as applicable, Section 21-12.04 of the Zoning Ordinance of the City of South Bend, <br />Indiana (the "Zoning Ordinance"), states that denial of Museum's Certificate of Appropriateness <br />Petition No. 2020-0302 (the "Petition") by Respondent/Appellee SOUTH BEND HISTORIC <br />PRESERVATION COMMISSION ( "HPC") at the June 16, 2020 HPC meeting was not supported by <br />the facts and applicable law. A true and accurate copy of the Certification of Record is attached <br />as Exhibit 1. The Museum timely filed its Notice of Appeal on July 7, 2020 (the "Notice of <br />Appeal"). A true and accurate copy of the Notice of Appeal is attached as Exhibit 2. For these <br />reasons and as shown more fully below, the Museum respectfully asks the Common Council to <br />reverse the decision of the HPC and approve the Museum's Petition. <br />-I- <br />
