Martin, Clerk <br />ADOPT RESOLUTION NO. 13-2020 — A RESOLUTION OF THE CITY OF SOUTH BEND <br />PUBLIC WORKS ON IMPLEMENTING TEMPORARY PARKING RULES IN <br />DOWNTOWN SOUTH BEND <br />Upon a motion made by Ms. Maradik, seconded by Mr. Molnar and carried by roll call, the <br />following Resolution was adopted by the Board of Public Works: <br />RESOLUTION NO.13-2020 <br />A RESOLUTION IMPLEMENTING TEMPORARY PARKING RULES <br />IN DOWNTOWN SOUTH BEND <br />WHEREAS, in response to the COVID-19 virus pandemic, national, state and local <br />government leaders and regulatory authorities have issued executive orders and directives for the <br />continuation of essential government services and operations, and the temporary suspension of <br />non -essential government services and operations; and <br />WHEREAS, on March 19, 2020, City of South Bend Mayor, James Mueller, signed <br />Executive Order,01-2020 in support of the City taking steps to mitigate the spread of the virus; <br />and <br />WHEREAS, on April 6, 2020 Governor Holcomb signed Executive Order 20-18 <br />directing each governmental body to determine its "Essential Governmental Functions" and to <br />identify employees and /or contractors necessary to the performance of those functions. The <br />Order also encouraged individuals, to the greatest extent possible, to use online or call -in <br />ordering of goods and services with either delivery or curbside pickup; and <br />WHEREAS, Chapter 20, Article 1, Sections 20-3 of the South Bend Municipal Code <br />authorizes the Board of Public Works to designate certain streets, alleys, and municipal parking <br />facilities or parts thereof, where parking is restricted to a specified maximum time or where <br />parking is restricted to temporary stopping or standing for loading and unloading purposes; and <br />WHEREAS, according to Downtown South Bend, there are fifteen (15) restaurants that <br />remain open downtown; and dedicated parking in front of the restaurants would greatly optimize <br />their ability to provide carry -out service to customers; and <br />WHEREAS, there a number of South Bend employees performing essential <br />governmental functions where unlimited parking downtown would greatly enhance their ability <br />to perform their duties; and <br />NOW, THEREFORE, BE IT RESOLVED by the City of South Board of Public Works <br />as follows: <br />1. Enforcement of one (1) and two (2) hour parking limitations in the downtown South Bend area is <br />temporarily suspended for up to ninety (90) days. <br />2. For a period of up to ninety (90) days, dedicated ten (10) minute parking will be permitted in <br />front of open restaurants in the downtown area. Each such restaurant will be able to receive up to <br />two A -frame signs that read: "10-minute parking curbside pick-up only." <br />3. This Resolution will expire of its own accord the earlier of the end of the public health emergency <br />or 90 days from its effective date. <br />ADOPTED at a meeting of the Board of Public Works of the City of South Bend, Indiana <br />held electronically on April 14, 2020. <br />
