The terms defined in this Section 101 or in the Preamble <br /> hereto (except as herein otherwise expressly provided or unless the context otherwise requires) • <br /> for all purposes of this Indenture and of any indenture supplemental hereto shall have the <br /> respective meanings specified in this Section 101 or in the Preamble hereto. <br /> "Act" means Title 36, -Article 7, Chapter 12 of the Indiana Code, as amended. <br /> . "Beneficial Owner"- means, with respect to Bonds while in• a Book-Entry Form, each <br /> person who beneficially owns such Bond(s) and on whose behalf, directly or indirectly, such <br /> Bond is held by the Depository pursuant to a Book-Entry System. <br /> "Bond Counsel" means any attorney at law or firm of attorneys, of nationally recognized - <br /> standing in matters pertaining to the federal tax exemption of interest on bonds issued by states - <br /> and political subdivisions, and duly admitted to practice law before the highest court of any state <br /> of the United States of America or the District of Columbia. <br /> "Bond Fund" means the Bond Fund established pursuant to Section 401. <br /> "Bondholder",or "holder" or "registered owner," when used with respect to any bond, <br /> means the person or persons in whose name such bond is registered, provided that, with respect <br /> to Bonds while in Book-Entry. Form, for purposes of any consent or approval hereunder, the <br /> term "Bondholder" shall mean the Beneficial Owner. <br /> "Bond Register" and "Bond Registrar" have the-respective meaning specified in Section <br /> 207. <br /> "Bond Year" means the annual period ending on (1) November 1 of each year <br /> (commencing November 1, 1992) occurring on or before the final Payment Date on the Bonds. <br /> "Bonds" means$4,340,000 City of South Bend Health Care Facilities Revenue Refunding <br /> Bonds Fountainview Place of South Bend Issue (FHA Insured Project) Series 1992 A. <br /> "Book-Entry Form" means Bonds which are held in the name of the Depository (or its <br /> nominee) with each maturity evidenced by a single Bond certificate. <br /> "Book-Entry System" means a system of record keeping, securities clearance and funds <br /> transfer and settlement maintained for securities.by the Depository and Participants. <br /> 3152.1 <br />
