REGULAR MEETING SEPTEMBER 25 2012 316 APPROVE CONSENT TO ANNEXATION AND WAIVER OF RIGHTS TO REMONSTRATE --- 51700 ORANGE ROAD – SEWER Mr. Inks stated that the Board is in receipt of a Consent to Annexation and Waiver of Right to Remonstrate as submitted by Mr. Harold D. Benninghoff. The Consent indicates that in consideration for permission to tap into public sanitary sewer system of the City, to provide sanitary sewer service to the above referenced property at address (Key # 004 -1010- 0174.01), Mr. Benninghoff waives and releases any and all right to remonstrate against or oppose any pending or future annexation of the property by the City of South Bend. Therefore, Ms. Roos made a motion that the Consent be approved. Mr. Inks seconded the motion, which carried. BOARD PRESIDENT JOINS MEETING IN PROGRESS Mr. Gary A. Gilot, President of the Board, joined the meeting in progress, at 10:38 a.m. APPROVE REIUSSUE OF WASTEWATER DISCHARGE PERMIT S In a Memorandum to the Board, Ms. Kim Thompson, Division of Environmental Services, submitted Wastewater Discharge Permit(s) for reissue and recommended approval on behalf of- Pioneer Metals 2424 Foundation Drive Suzuki Garphyttan Wire 4404 Nimtz Parkway Steel Warehouse 2722 West Tucker Drive TK Warehouse 3702 West Sample Street There being no further discussion, upon a motion made by Ms. Roos, seconded by Mr. Inks and carried, the above permits were approved for reissue. RATIFY APPROVAL AND /OR RELEASE CONTRACTOR OCCUPANCY AND EXCAVATION BONDS Mr. Anthony Molnar, Division of Engineering, recommended that the following Contractor and Excavation Bonds be ratified pursuant to Resolution 100 -2000 and /or released as follows: Business Bond Type Heiman Construction, Inc. Contractor SIR Home Improvements, Inc. Contractor Paul Royer D /B /A Al Concrete Excavation Imperial Crane Services, Inc. — Approved/ Released Approve Released Effective Date September 6, 2012 .September 14, 2012 September 25, 2012 September 6, 2012 Mr. Mecham made a motion that the Bonds approval and/or release as outlined above be ratified. Ms. Roos seconded the motion, which carried. APPROVE CLAIMS Mr. Inks stated that a request to pay the following claims in the amounts indicated has been received by the Board; each claim is fully supported by an invoice; the person receiving the goods or services has approved the claims; and the claims have been filed with the City Fiscal Officer and certified for accuracy. Naive Amount of Claim Date City of South Bend $4,135.08 09/17/2012 and 09/20/2012 City of South Bend $2,3829893.91 09/25/2012 St. Joseph County Housing Consortium $68,387.63 09/0612012 Therefore, Mr. Inks made a motion that after review of the expenditures, the claims be approved as submitted. Ms. Roos seconded the motion, which carried. ADJOURNMENT There being no further business to come before the Board, upon a motion made by Mr. Inks, seconded by Mr. Mecham and carried, the meeting adjourned at 10:43 a.m.
