(Architectural services, Le <br />Peep Restaurant) <br />i. Commission authorization requested to <br />submit an application to enter the Oliver <br />Plow Works site to the Indiana Department <br />of Environmental Management Voluntary <br />Remediation Program. <br />Mr. Laurent noted that the application is the first <br />step in getting the site cleaned up and putting it <br />back into productivity. The application will be <br />processed by IDEM to determine if the site is <br />eligible to enter the program and then a <br />remediation work plan will be submitted for <br />approval to IDEM. Participating in the <br />voluntary program will provide a "covenant -not- <br />to -sue" letter from IDEM/EPA, which will <br />indemnify future property owners from <br />environmental liability for the contaminants <br />addressed during the VRP process. <br />Upon a motion by Mr. Kahn, seconded by <br />Ms. Jones and unanimously carried, the <br />Commission authorized the staff to submit the <br />application to enter the Oliver Plow Works site <br />to the Indiana Department of Environmental <br />Management Voluntary Remediation Program. <br />j.
