Davis, M.D, <br />Vice President, Board of Health <br />i <br />ORDER OF ABATEMENT <br />December 8, 2017 <br />Anne Marie Pelino & Ryan Lynch <br />1312 Lincoln Way East <br />South Bend, IN 46613 <br />RE: Lead-based paint hazards at 1312 Lincoln Way East, South Bend, IN 46613 <br />Dear Sirs; <br />On October 20, 2017, an Environmental Health Specialist from the Health Department conducted a lead risk <br />assessment at the address shown above. Our investigation found deteriorated lead based paint on the interior <br />and exterior of the home. Risk assessment results and remediation options are attached. <br />The current condition of the home is a threat to public health because lead poisoning can cause permanent <br />health problems in children, including brain damage, learning disabilities, behavioral problems, and liver and <br />kidney damage. In extreme cases, seizures and death can occur. This condition is a threat to the health of the <br />children living at or visiting the residence. <br />The Health Department would like to help you eliminate these hazards, but ultimately the responsibility for <br />eliminating them is the property owner/s. <br />Many lead hazards may be easily corrected. Often, all that is needed is a good cleaning and a fresh coat of <br />paint. The Health Department can give you technical advice to help you deterinine your property's needs. <br />We can also loan you a HEPA vacuum. <br />Indiana law requires that the Health Department provide you with options for eliminating the lead hazards <br />and that you eliminate the hazards within 60 days of receiving the risk assessment results. <br />The condition in your home violates the following laws: <br />• Indiana State Department of Health Rule 410 IAC 29 which addresses preventive procedures for lead <br />poisoning. <br />• Indiana Code 16-20-1-25 which addresses threats to public health. <br />• Indiana Code 16-41-20-1 which addresses dwellings unfit for human habitation. <br />Please send all electronic correspondence for the Environmental Health Division to envirohd@co.st•joseph.in.us <br />Environmental Health Division • 227 W.
