HISTORIC PRESERVATION COMMISSION <br />• OF <br />SOUTH BEND AND ST. JOSEPH COUNTY, INDIANA <br />BY-LAWS <br />Amended and adopted February 19, 2018 <br />ARTICLE 1. <br />NAME; ESTABLISHMENT; MISSION <br />Section 1. Name. This organization shall be known as the Historic Preservation <br />Commission of South Bend and St. Joseph County, Indiana (the "Commission"). <br />Section 2. Establishment. By virtue of the City of South Bend's Ordinance No. <br />5565-73 adopted on September 10, 1973, and St. Joseph County's Ordinance No. 154-73 <br />adopted on May 14, 1973, the Commission was established as a joint board for purposes <br />of historic preservation in the City and the County. The Commission has been <br />perpetuated and operates pursuant to Article 13 of Chapter 21 of the South Bend <br />Municipal Code, as may be amended from time to time (the "City Ordinance"), Title XV, <br />Chapter 154, §§ 154.245-154.263 of the St. Joseph County Code of Ordinances, as may <br />be amended from time to time (the "County Ordinance"), and the terms of the Interlocal <br />Agreement between the County and the City dated December 12, 2017, as the same may <br />• be amended from time to time (the "Interlocal Agreement"). <br />Section 3. Mission. The Commission's mission is to identify architecturally or <br />historically significant buildings, structures, sites, and objects in the City and the County <br />and to promote the protection and preservation of the same in a manner that enhances <br />both human and economic welfare and that accommodates development and <br />redevelopment in the City and the County. <br />ARTICLE 2. <br />MEMBERSHIP <br />Section 1. Membership; Vacancies, Absences. The Commission shall consist of <br />nine (9) members as set out and provided for by the City Ordinance, the County <br />Ordinance, and the Interlocal Agreement. Vacancies on the Commission and absences of <br />a member of the Commission will be addressed in accordance with the terms of the City <br />Ordinance, the County Ordinance, and the Interlocal Agreement. <br />Section 2. Codes of Ethics. All members of the Commission are subject to the <br />City of South Bend Ethics Code of January 1, 2012, as amended from time to time (the <br />"City Ethics Code"). In addition, the National Alliance of Preservation Commissions <br />Code of Ethics in the form set forth below (the "NAPC Code") is adopted to govern the <br />
